As of 10/1/11, a Balanced Budget Amendment has not been introduced for an up or down vote, nor has the repeal bill https://docs.google.com/document/d/1jK6-kGCB_Dbb5K98YSS9o9kSNBwLJsSb7XQ5GQSvTks/edit?authkey=CIS_je8I&hl=en_US been introduced in place of H.R. 4872. Therefore, even though there has been this repeal bill submitted since August of 2010, Congress has been occupied with federal funding issues, the debt ceiling, and the interest on the deficit.

As we push for entitlement reform, this Act should work as a stabilization mechanism to absorb the shock of sustained unemployment, and from Congressional tug-of-war. State governments can not be held in the balance of whether or not the federal government faces shutdown again in March, before addressing these issues now at state level. It is imperative that we consider other legislation or ideas that we can apply to budgetary finance to alleviate these burdens, to prepare a plan for faltering recovery and lack of positive change.

Every Governor should write Congress with a copy of this letter or link, in support of the Balanced Budget Amendment. States by law, are required to balance the budget yearly without carrying a deficit. The same should be true of Congress and the federal budget, as states can not print more money against the Federal Treasury and value of gold to manipulate the dollar, nor can states engage in the buying and selling of debts for profit, or in exchange for lucrative favors from constituents for campaign financing.

We are ending and withdrawing from the wars and occupation of Iraq and Afghanistan, less concerned with fighting more ground wars, and though Pakistan has presented its own challenges with seeming coup, the success of drones and our smoking out the Taliban by driving them from their strongholds to Yemen has changed our location, tactics, and appropriations. We are putting everything on the table to deal with the deficit.

Furthermore, we may begin to audit our own state budgets for weaknesses or deficits, and then fine leadership accordingly for not adhering to federal law. California is the most glaring abuse of federal law, and it has the most state debt, carrying an unlawful deficit of nearly $10 billion. A circular and audits are to be sent to the federal government by 1/1/12, to develop a consensus on how to strengthen the state of California, or if they will have to be put on federal probation until new leadership is elected.

With Cut, Cap, and Balance narrowly now passing in the House, now is not the time to let go of the Congressional rope, and we must hold fast to fiscal responsibility and supporting the House GOP and Tea Party Freshmen in their endeavors.

Here are several other ideas that we can use to restrict federal gluttony that Democrats call “deficit spending”: the Balanced Budget Amendment must be more than  just a declaration to balance the budget and reconcile the deficit. Congress has tried for the better part of 20-30 years to balance the budget.

For once, Senator Harry Reid is right: the debt ceiling is not an issue not unknown to Congress and senior leadership, during their tenure, and it will still be an issue after they’re gone. Yet, whomever has had majority control of the House or Senate in the past has been able to make the concessions necessary to move past gridlock. Only in recent years, we have been at an impasse. With as much as Senator Harry Reid blames the Tea Party, he can not blame them for the money that has been wasted since he raised the debt ceiling in 2006, while Obama was a Senator. Both of them were against it then, but they have gone against their own principles in raising the debt ceiling and Congress, and in making open declarations of war.

With that said, the Balanced Budget Amendment must have four components, or it is not even worth voting for, as it will only be a symbolic or roll call vote. (Taken from Glenn Beck’s “Broke”)
1) Spending can not be higher than the prior year’s amount, plus the rate of inflation and population growth.
2) If, at the end of a given fiscal year, the estimates were wrong and the budget is still not balanced, the difference would automatically be cut from the next fiscal year according to a very specific predetermined formula.
3) An exception can be included for a war declared by Congress, or a national calamity. The benchmark for meeting the definition of the latter would need to be quite high, think something in the range of 90% of the members of Congress agreeing. That may seem like an unrealistic bar, but how many politicians would have voted against declaring 9/11 or Hurricane Katrina a national calamity?
4) Federal expenses can not be pawned off on the states.



Without these 4 provisions being spelled out on paper, a Balanced Budget Amendment is useless, as Congress has quibbled and puckered about how to handle funding for years, and Congress must restrict itself to the four umbrellas of original design, and these cuts will be in another Act, on the model of governance. The audits will determine which programs are proposed to be cut based on that model, in accordance with these Conservative principles of the Balanced Budget Amendment.

Other legislation that Conservative leaders have in their quiver are:

1) Passing a line-item Veto amendment - which Clinton successfully used as a scalpel to cut out spending. While Obama talks about it, it is necessary to place it in his hand as a tool, to see if he would use it. So far, his OMNIBUS BILL PACKAGES have yielded economic disaster, and he is not the President who possesses the bipartisanship or leadership integrity to use it, yet we may certainly pass it for his successor as we press to impeach him for constitutional abuses.
2) the S.A.F.E. Act of 2010 - gives us all the provisions of the BBA without the controversy of an up or down vote on it, without having to sandwich the BBA as tagline legislation, when it is a constitutional amendment. The S.A.F.E. Act forces everyone to put their cards on the table about spending. Nothing is left to the imagination of taxpayers, nothing is hidden in subcommittee decisions, and nothing is decided by a controversial or super delegation or a dozen appointed legislators or Super Congress. I propose the S.A.F.E. Act as an alternative, if we are not satisfied with the outcome by Thanksgiving of this year and the automatic spending cuts scheduled to kick in, already this January 2012.
3) The GWB JR. VETO - would give Obama’s successor the power to freeze spending line-by-line, rather than outright deny it. This gives Congress and the President the ability to approve bills and delay funding, as needed, rather that starting from scratch on legislation no one finds makes the grade.
4) Return Impoundment Authority - Jefferson, using this, returned money to the budget deemed frivolous or unnecessary expenses. This authority gives the President the ability to seize and return funds to the Treasury. This gives the President authority to not automatically fund entitlements, while keeping pork out of bills.
5) Expand PAY-GO to include all budgetary items for funding review, rather than just non-discretionary selective items. This expands the current “YOU CUT” programs to keep integrity in entitlements, when they are subject to taxpayer cuts. We call this: “fund what you want to have”, rather than the government functioning as a financing machine off of Social Security and Federal Reserve IOU’s. (The debtor credit, where our debt is sold to other countries).
6) Pass a “Common Sense Lobbying Act” with these provisions, it prevents lobbying abuses of nepotism, favoritism, and grant preference given to large donors. This Act, next to repealing over 200 regulations from Obama, would be the icing on the cake to give us a course of action on financial reform legislation already passed. In other words, after four years you can become a lobbyist after leaving public office, and no family members of current Congress members can lobby.
7) No war or funding for war, unless it is appropriated for intelligence that can be issued except through Congress as a declared act of war. This restores our dealings and transparency with other countries, while keeping the amounts appropriated readily viewable to the taxpayers. This way, we don’t have the military lobbying the President; the military would go through an appropriations committee that oversees Homeland Security, and the President would adjust his budget accordingly to balance that with defense cuts or other cuts.
8) Commission Appointees - in the future, Congress must select private sector, educated, business people to Financial Reform Committees. That way, they are not politically motivated in making cuts or have vested interests in protecting programs.
9) Implement California’s Prop. 11 - to prevent gerrymandering and reduce inequality in voting districts and representation by Citizen Appointed Commission, like a jury.
10) No bonds issued to foreign countries - debt would then be locally managed and controlled.
11) SEIU ACT - Unions can not control the entire job market and monopoly rules would apply.
12) Congressional Reform Act - it used to be that Congress was a part-time endeavor, and they actually farmed or worked, which made them public servants, not political harlots. We should elect members of Congress who work, pay in, and run their own business. Prohibit fundraising during session, which reduces the time and money to investigate fraud, and place term-limits.
13) Introduce the Legislation Integrity Act - no more omnibus bills, fine the leadership for not having a yearly budget on time, and if the bill doesn’t fit a parameter of reasonable length, purpose, and funding amount in clear view, it does NOT get brought to the floor, period!

Post Office's Rescue Plan: Junk Mail By JENNIFER LEVITZ

Many consumers are irked by the catalogs, credit-card pitches and other "junk mail" they receive. But the U.S. Postal Service loves it—and wants to deliver more.
The agency, beset by historic losses and a plummet in first-class mail, is running promotions, easing rules and planning television and radio ads to encourage more businesses to send pitches by standard mail, the official term for bulk mailings used by marketers to prospect for customers.
"What we want to do is to make standard mail more interesting for customers so we can grow the total volume," Postmaster General Patrick Donahoe said in an interview. "We don't call it junk mail—it's a lucrative avenue for anyone who wants to reach customers."

The volume of first-class mail—used for everything from birthday cards to thank-you notes—continued its decline in fiscal 2011 that ended Sept. 30. It fell 7% versus a year ago through August, the latest figures available.
But advertising mail increased 3% after remaining flat in fiscal 2010, and now accounts for 48% of all mail, according to the postal service. The mailings, requiring at least 200 pieces or 50 pounds, have average postage fees of 19 to 21 cents a piece and a delivery time of two to nine days.
The postal service is trying to promote advertising mail that "matches up digital and hardcopy" mail, as a way to show companies that physical mail can drive consumers to their websites, Mr. Donahoe said. In July and August, the agency gave a 3% discount to any piece of advertising mail that had a special code that could be read by a smartphone.
The agency is also encouraging small businesses to use direct mail. It generated 501 million pieces of new advertising mail and $75 million in revenue between March and late September by easing rules on bulk mailing. Businesses can bring as many as 5,000 pieces of advertising mail a day to the post office, to be delivered by a carrier to every home on a route, without an exact name or address on the envelope, for 14.2 cents apiece. In the past, the postal service required envelopes to be fully addressed, which meant merchants had to purchase mailing lists.
EMQ FamiliesFirst, a nonprofit social-service agency in Campbell, Calif., gets more new donors through online pitches, but finds that online donations go up after a print piece is also sent to the house, said spokeswoman Kristine Austin.
Overall, the postal service says it makes money on advertising mail—but it could make more. Contributing to the agency's record $8.5 billion shortfall in fiscal year 2010 was a loss of $1.7 billion on several mail products that didn't cover costs, including advertising-mail flat packages—typically catalogs—advertising-mail parcels, and the separate category of periodicals, according to the Postal Regulatory Commission. The postal service said in fiscal 2010 standard mail covered nearly one and a half times its cost.
First-class mail accounted for 50%, or $34 billion, of the postal service's total revenue in the 2010 fiscal year. Advertising mail had higher volumes but brought in $17.3 billion, or only 26% of total revenue, due to hefty discounts and lower rates.
Consumers received 82.5 billion pieces of advertising mail through the postal service in 2010, down 20% from a 2007 peak of 103.5 billion pieces, but far more than the 63.7 billion pieces they received in 1990.
Only 1.4% of households made a purchase, opened a checking account, or otherwise responded in 2010 to advertising mail sent to potential new customers, according to the Direct Marketing Association, a trade group. That's down from 1.7% in 2005.
Email pitches to potential new customers have an even weaker response rate, at 0.62% in 2010, according to the trade group, which added that response rates are higher for advertising mail sent to existing customers. Still, email's low costs and ubiquity have been shaking up the direct-marketing business for more than a decade.
Boosting advertising mail is just one tactic the financially strapped postal service is turning to as it seeks to boost revenue. It also recently announced it's launching a campaign to sell off its property, from huge processing facilities to post offices, including some built in the 1930s New Deal era.
The agency will study selling 252 of its 487 mail-processing centers in the hope of saving up to $3 billion annually. It sold $140 million in post offices and other property so far in fiscal year 2011. The postal service also may close one in 10 of its 32,000 post offices to save money.

The postal service is "continuing to work with the commission to more equitably allocate costs," said agency spokeswoman Yvonne Yoerger.
The agency, however, is limited by law on how much it can raise postage rates, and said it doesn't want to drive away customers. "Yes, products should cover their costs, but... our volume is already declining and we don't want to further push people out," she said. A bill filed recently by Sen. John McCain, (R., Arizona) would require all mail to cover its costs. Some consumers feel that in some cases, they are subsidizing advertising mail that they don't want.
"It's astonishing... they should have to pay the same rate as everyone else." said Wallace Embry, a retired chemist in Columbia, Tenn. "I rip most of it up," he said.
Postmaster Donahoe said while people may complain, he believes they like their coupons and other advertising mail and may trust it more than email.

Leader Cantor Statement On Senate Repatriation Bill

WASHINGTON, D.C. – House Majority Leader Eric Cantor (R-VA) released the following statement regarding legislation introduced today by Senator John McCain (R-AZ) and Senator Kay Hagan (D-NC) that would lower the corporate tax rate to allow American companies to bring home trillions in profits held overseas. In May, the House introduced a bipartisan repatriation bill as part of the House Republicans’ plan for job creators.
“American companies currently pay one of the highest tax rates in the world. Real tax reform is extremely important, but in the interim, encouraging businesses to bring overseas earnings back home to America will spur investment, economic growth and job creation. At a time when we need to take every possible step to ensure that America remains the best place to do business, Senator McCain and Senator Hagan’s legislation is the latest evidence of bipartisan support for repatriation and I applaud their effort.”

The Supreme Court of the United States (SCOTUS) has convened for its 2011/12 term, and one case before the court will determine whether the central government can nationalize another one-sixth of the American economy. Call itThe American people v. ObamaCare.
For the record, that would be one-sixth of what remains of free enterprise after all the nationalization already undertaken by Barack Hussein Obama, ostensibly to "save the economy." If Obama and hissocialist cadres continue to undermine free enterprise at the current pace, his goal of "fundamentally transforming the United States of America" into a socialist democracy will be assured, regardless of the victors in the next election cycle.
Indeed, the rapidly growing ranks of Americans already dependent upon government subsidies (approximately 32-35 percent), many of whom are content to vote for the redistribution of others' incomes rather than work for their own, greatly influences national elections. That dependent electorate, combined with the government's control over tens of millions of other American incomes by way of nationalization and regulation, increases the number of its dependents to about 40 percent, which poses a perilous threat to Liberty. Think about it this way: Forty percent of Americans are, to varying degrees, fiscally addicted to the public treasury. Is it any wonder that American Liberty is under siege, and that its future is in question?
Responding to a complaint by 26 states, the U.S. 11th Circuit Court of Appeals struck down the "individual mandate" in so-called "Patient Protection and Affordable Care Act" (ObamaCare). The mandate itself is an unprecedented statist requirement that every American buy an insurance product or service and have proof of coverage. As such, it is a gateway measure for governmental authority to define not only the type of coverage but also the degree.
If SCOTUS fails to uphold the Circuit Court's ruling, ObamaCare will be well on its way to increasing the number of Americans whose incomes are directly regulated by the central government to well over 50 percent. The implications for "free and fair" elections are ominous, given that a majority of Americans would then have an economic interest in electing only those who promise to continue doling out the "free" goodies.
As you recall, when asked about the constitutionality of ObamaCare legislation prior to its shamefully rigged House and Senate passage, Democrat leadership simply scoffed and rebutted, "Nobody questions that." Despite the unmitigated arrogance of those on the Left, who treat our Constitution as a doormat, the Supreme Court will have to answer that question.
That answer will depend on whether the number of justices who abide by their oaths "to support and defend" the United States Constitution and Rule of Law as enshrined within it outnumber those justices who have utterly abandoned their oaths in favor of the rule of men under the so-called "living constitution." Put simply, the Supreme Court will be charged with upholding the supreme contract between "We, the People" and our government.
The Obama administration is trying to fast-track this critical decision. How is SCOTUS likely to rule? Here is the current High Court breakdown.
On the side of Rule of Law, those more inclined to adjudicate based upon what our Constitution actually prescribes and proscribes, are four justices, including Chief Justice John Roberts (age 56), appointed by George W. Bush in 2005; Justice Antonin Scalia (age 75), appointed by Ronald Reagan in 1986; Justice Clarence Thomas (age 63), appointed by George H.W. Bush in 1991; and Justice Samuel Alito (age 61), appointed by George W. Bush in 2006.
On the Left are Ruth Bader Ginsburg (age 78), appointed by Bill Clinton in 1993; Stephen Breyer (age 73), appointed by Clinton in 1994; Sonia Sotomayor (age 57), appointed by Barack Obama in 2009; and, Elena Kagan (age 51), appointed by Obama in 2010.
On the fence would be the ninth justice, Anthony McLeod Kennedy (age 75), a heretofore unreliable justice appointed by Ronald Reagan in 1988, in the wake of the Democrats' vicious and unprecedented assault on Reagan's original appointee, Robert Bork, one of our nation's pre-eminent jurists.
My prediction in the ObamaCare case is a 5-4 split, with Kennedy voting with the majority -- which majority, I cannot predict. As Leftists in both the legislative and executive branches have entirely abandoned their obligation to uphold our Constitution, fending off a substantial threat to Liberty now rests in the hands of one loyalty-confused Supreme Court justice.
If the Court upholds the 11th Circuit's decision, it will be the most significant strike against national legislation since rulings against Franklin Roosevelt's socialist regime in the 1930s.
Florida Attorney General Pam Bondi correctly concludes that affirming the 11th Circuit's decision would be a major step to "define the boundaries of Congress' power" and "defend Americans' rights and freedoms."
However, if the Supremes do not uphold the 11th Circuit's decision, batten down the hatches. Until which time ObamaCare can be fully repealed by congressional majorities which do abide by their oaths, House Republicans can and must use the authentic powers granted by our Constitution to de-fund ObamaCare and block enactment of any further provisions. Of course, that will require leadership...
In closing, may I remind you that the next president will have the opportunity to nominate one or more Supreme Court Justices?


'Furious' mess has Justice in full panic

So now the Fast and Furious affair has reached Stage 2 of the classic Washington scandal: House Republicans have called for a special counsel to investigate Attorney General Eric Holder himself for possible perjury.
Justice Department documents indicate that Holder knew of the operation way back in July 2010 -- far earlier than the “in the last few weeks” that he told congressional investigators under oath last May.
Memos from Assistant Attorney General Lanny Breuer and others to Holder clearly show the scope, if not the nature, of the disastrous project: “This investigation, initiated in September 2009 . . . involves . . . straw purchasers [who] are responsible for the purchase of 1,500 firearms that were then supplied to Mexican drug cartels.”
That’s the crux of the Department of Alcohol, Tobacco, Firearms and Explosives’ infamous “gunwalking” program, allegedly designed to track illegal gun sales to Mexican drug gangs by turning a blind eye toward, and possibly facilitating, arms sales in Arizona and elsewhere. The death toll so far is more than 200.
The heavily redacted memos don’t explicitly implicate ATF and other federal agencies in an illegal scheme, as ATF whistleblowers have alleged. But if there’s a coverup going on, why would they?
And coverup there seems to be. On top of stonewalling Rep. Darrell Issa’s House investigation of the mess, Justice has floated a series of contradictory excuses:
* There was no such program.
* Even if there weres, Holder never knew about it.
* Even if he should have known about it, he might not have read Breuer’s memos.
* Even if he read Breuer’s memos, he misunderstood the simple question: “When did you first know about the program, officially, I believe, called Fast and Furious?”
With the recent exposure of another apparent “gunwalking” operation, Wide Receiver, that may date back to the Bush administration, some are already pushing a “Bush-did-it-too” meme. If true, it shows the rot at Justice goes deeper than we thought -- but it has nothing to do with whether Holder may have committed perjury.
If Holder is so innocent, why, sources inside Justice say, are folks there engaging in a panicked orgy of finger-pointing and blame-shifting?
A trial balloon has reportedly been floated within Justice to essentially eliminate the ATF by firing 450 agents and transferring the embattled agency’s duties to the Drug Enforcement Administration and the FBI.
While the bulk of the national press corps is off inspecting Texas Gov. Rick Perry’s back forty for residual signs of racism, CBS’ Sharyl Attkisson and Fox’s William La Jeunesse have been doing the heavy lifting on Fast and Furious -- and getting some tough pushback from Obama officials.
On the Laura Ingraham radio show yesterday, Attkisson told of being “yelled at” by Justice flack Tracy Schmaler and being “screamed” at by White House official Eric Schultz for being “unfair.”
Said Attkisson: “They will tell you that I’m the only reporter -- as they told me -- that is not reasonable. They say The Washington Post is reasonable, the LA Times is reasonable, The New York Times is reasonable, I’m the only one who thinks this is a story, and they think I’m unfair and biased by pursuing it.”
CBS has reportedly yanked Attkisson from further media appearances this week. But isn’t independent inquiry the function of a free press? Nobody thought there was a story in Watergate, either, until Woodward and Bernstein proved otherwise.
There’s still plenty of time for Justice and the other implicated agencies to come clean. But to date, all we’ve heard is dog-ate-my-briefing-book excuses and desperate attempts to change the subject.
It’s possible that Fast and Furious was a rogue, poorly conceived sub-operation of the legitimate Project Gunrunner, begun in 2005 to track and interdict illegal weapons traffic. But Holder’s track record in previous congressional testimony leaves ample cause for skepticism.
As former federal prosecutor Andrew McCarthy pointed out yesterday at National Review Online, Holder’s current amnesia recalls his misleading testimony to Congress about another scandal, President Bill Clinton’s pardon of fugitive financier Marc Rich. Even though Holder helped arrange the pardon, he told the Senate Judiciary Committee in 2001 that Rich’s name was “unfamiliar” to him.
With the 2012 elections looming, the chances of Holder’s appointing a special prosecutor to investigate himself are slim and none. The Obama administration will bury the scandal -- unless the media and public demand otherwise.

(Sep. 29, 2011) — Several readers of The Post & Email have confirmed that Walter Fitzpatrick has been returned to the Monroe County, TN jail.  Fitzpatrick was arrested when he walked out of his sentencing hearing on September 23, 2011 after reading a statement which claimed that the court had no jurisdiction over him.
The phone number to inquire about his well-being and treatment at the jail is 423-442-3911.  However, Monroe County sheriff’s deputies have been known to lie.  The address where letters can be sent is here.
The Post & Email has contacted Gov. Bill Haslam‘s office, the Speaker of the Tennessee House of Representatives, State Sen. Stacey Campfield, State Sen. Mae Beavers, and Lt. Gov. Ron Ramsey’s office.  None of them has responded to our request to investigate corruption within the judiciary in Monroe County and greater Tennessee.
We contacted the Tennessee Administrative Office of the Courts regarding Gary Pettway, who served as a rubber-stamp grand jury foreman for at least 27 years without having been duly appointed or sworn in but received no response.

There seems to be a problem in the execution of the Patriot Act, on the citizens of the United States and on our military.
In 2006, my Habeas corpus was violated: http://en.wikipedia.org/wiki/Habeas_corpus I have written Congress at length, as we had only considered extending the Patriot Act through December, because of various abuses of its application like this. The vote was taken for such extension, but I then received a letter from Senator Johanns that the Act would be extended until 2015, which is not what we supported or voted for, especially after signing this:

Now, I can read from Fitzpatrick's remarks, that he served in our military in a time when it was honorable and when he believed courts to be the same, and I believe that he is not asking the state of Tennessee for a free pass.
I do believe that the court here in Monroe County has exceeded its authority over a military officer, especially with Fitzpatrick's options for legal defense and counsel as a retired veteran, and with his ability to sue Monroe County for his unlawful detainer. Citizens who often feel the malaise of the Patriot Act are reluctant to sue their County or municipality, because we feel a responsibility to the whole in providing a judiciary, even when it has slapped us in the face or egregiously abused its power over us, who are educated enough to know that they have done so, because of the Patriot Act's misapplication.
My question: why is Fitzpatrick still being detained, why did the judge feel it necessary to disrespect a uniformed officer in such a fashion?
Given these circumstances:
LDCR Walter Fitzpatrick, III (US Navy-Ret.) was taken by force on a public street on 23 September, 2011 in Monroe County, TN, and thrown in prison under a 6 month sentencing by a corrupt judge in an unlawful court. Here are the facts:
·         There were no formal charges against him ever issued;
·         No one signed a complaint, and there were no witnesses to any unlawful acts;
·         He was charged with an act that was never proven to have occurred, and, in fact, never did occur;
·         An unlawfully seated Grand Jury, with no sworn or lawful Grand Jury foreman, presented a No True Bill of a non-crime;
·         A warrant was sworn out for LCDR Fitzpatrick’s arrest – for not showing up in court for a hearing that did not need his presence, and he was not even notified of.  As a result:
·         LCDR Fitzpatrick suffered a home invasion: a ‘no-knock’ forced entry by sheriff’s deputies.  The homeowner (LCDR Fitz) resisted the invasion –and was instead assaulted, tasered, and wounded (ear almost torn off), and was himself charged with (counter) assault and resisting arrest.

He was held for 2 months in 2010 under deplorable conditions in the Monroe County jail for resisting that criminal and unwarranted home invasion.
On September 23, 2011, LCDR Fitzpatrick appeared in the Monroe County Court for ‘sentencing’ on a non-crime conviction (not the home invasion) by an unlawful court and an unlawful Judge based on a NO True Bill presentment by an unlawful Grand Jury led by an unlawful and unsworn foreman (Mr. Gary Pettway – ‘foreman’ for 27 years in a row, in violation of TN law that allows for no consecutive 1 year terms, even if lawfully sworn).
LCDR Fitzpatrick read a statement that he did not recognize the Court or the Judge or its validity – based on the foregoing, and walked out.

The Judge sent armed deputies after him, to capture him and bring him back into the unlawful Court, so the Judge could then have the audacity to say, in effect and with unlawful prejudice: I was going to give you Community Service, but since you disrespected this Court, I’m sentencing you to 6 months in prison.

It is precisely situations like this, that good citizens turn against government, why established government gets investigated, and why there is unnecessary turmoil and mistrust of government created in society.

Now, I pray that you release him with a letter of written apology from the arresting officers, and I pray he not mount a lawsuit against the state of Tennessee.

What is the Tea Party Treatise, you ask, and why was it written??

The Tea Party Treatise is a Citizen Drug and Safety policy, geared towards anti-corruption and personal wellness of the individual. It is also an agreement honored by those who sign it, who are interested in being Patriots without giving up our rights afforded as citizens of the United States, including legal issues of unlawful detainer.

In times of government gluttony, it is necessary to get specific with leadership, that we expect them to uphold the Constitution, and that we declare that personally and specifically in respect to public state and federal laws, and the interpretation in place by the Treatise. The law in and of itself is not; it is often the misapplication, abuse, or lack of understanding of its interpretation that brings unintended turmoil to society.

The Treatise is to correct abuses of the Patriot Act, and it is written to be used as a document for legal recourse to sue municipalities in which local law enforcement has applied a federal law to search and seizure without presenting you a signed warrant by a judge, entailing the nature for why they are investigating you, or asking to search your person, property, or dwelling. Hence, the death of Kathryn Johnston and no-knock warrants.

While it is not our mission to sue entities, unlike the chaff Westboro Baptist Church, (who cries religious discrimination to rob others and amass mammon for their church payroll and protesting activities), as a Cherokee, my intention is to live in peace with others with as little government intrusion as possible. I don’t have to pay taxes, but I do, and I have certain expectations of the system as a whole to act with integrity, to correct its mistakes, and to serve the people who pay taxes.

It is with great pleasure I inform you that I have not been arrested in 5 years, and that I fulfilled many childhood dreams of running my own business and pursuing journalism. These were not won by expecting anyone to fulfill this for me or provide me with the funds to do it; it has taken all of my money, time, and resources for the better part of 8yrs. now, and my endeavors have not been met with controversy: I have had my life threatened, I have been jailed without due process, I have had my Habeas corpus held in judicial limbo of politics and corrupt law enforcement. I have seen the arresting officer leave the County of my residence, the Sheriff involved with the corruption lose his election, and the ties to corruption at the Georgia Capitol fall.

(Reuters) - American militants like Anwar al-Awlaki are placed on a kill or capture list by a secretive panel of senior government officials, which then informs the president of its decisions, according to officials.
There is no public record of the operations or decisions of the panel, which is a subset of the White House's National Security Council, several current and former officials said. Neither is there any law establishing its existence or setting out the rules by which it is supposed to operate.
The panel was behind the decision to add Awlaki, a U.S.-born militant preacher with alleged al Qaeda connections, to the target list. He was killed by a CIA drone strike in Yemen late last month.

From this day forth, the Tea Party: comprised of various social, religious, and political groups, whose focus is fiscal responsibility and government accountability; meaning that the government is accountable to the people whom they serve and represent, petition the powers that be to rescind the Patriot Act, because it is unconstitutional. Our citizenship binds us to an irrevocable Oath, to do what is best for our country. With that stated, there are many laws that impose the government’s will that are not shared by current American sentiment or reflect the will of the people. This dissent has grown to an unimaginable din within a few short years, due to economic and financial repression, coupled with government ineptitude.
The first order of the “The Tea Party Treatise” is to bring social order and peace to our communities with respect to individual rights and community responsibility. Existing laws have been abused by Public Safety entities and the Judiciary to violate Habeas corpus, under the guise of preserving national security. This causes people to mistrust our leadership and government, and rightfully so. The Patriot Act bolstered existing laws to trump the Constitution and The Bill of Rights, which was never its original purpose, as it was written initially with good intentions and composed to serve as a balancing mechanism of justice. However, it is the interpretation of this Act, in accordance with other laws, that we find to be beyond the original design of limited government.
The imposition of mandatory one year sentences for breaking any provision of the Act, even if done so to preserve oneself and countrymen from danger, betrays justice in thwarting due process by underscoring the presumption of innocence before conviction of guilt. The Act punishes citizens for crimes against their country and discounts the guarantee of a quick and speedy trial, often with delays and imprisonment that punish an individual prior to a hearing or trial taking place, as the punishment is mete prior to proper hearing or trial, with a result of unlawful detainment, hefty fines, probation fees, and five to seven years probation with voting rights restricted. Soldiers are being crucified as “war criminals” and meeting a similar fate by same unconstitutional processes.
For these reasons, and for these about to be discussed, we implore the rights of our citizens and soldiers be fully restored by repealing the Patriot Act. In layman terms this means that in order to induce death a marijuana smoker would have to consume 20,000 to 40,000 times as much marijuana as is contained in one marijuana cigarette. NIDA-supplied marijuana cigarettes weigh approximately .9 grams. A smoker would theoretically have to consume nearly 1,500 pounds of marijuana within about fifteen minutes to induce a lethal response.

Mexico enacts 'personal use' drug law

MEXICO CITY (AP) — Mexico decriminalized small amounts of marijuana, cocaine and heroin on Friday — a move that prosecutors say makes sense even in the midst of the government's grueling battle against drug traffickers.
Prosecutors said the new law sets clear limits that keep Mexico's corruption-prone police from shaking down casual users and offers addicts free treatment to keep growing domestic drug use in check.
"This is not legalization, this is regulating the issue and giving citizens greater legal certainty," said Bernardo Espino del Castillo of the attorney general's office.
The new law sets out maximum "personal use" amounts for drugs, also including LSD and methamphetamine. People detained with those quantities no longer face criminal prosecution.
Espino del Castillo says, in practice, small users almost never did face charges, anyway. Under the previous law, the possession of any amount of drugs was punishable by stiff jail sentences, but there was leeway for addicts caught with smaller amounts.
"We couldn't charge somebody who was in possession of a dose of a drug, there was no way ... because the person would claim they were an addict," he said.
Despite the provisions, police sometimes hauled in suspects and demanded bribes, threatening long jail sentences if people did not pay.
"The bad thing was that it was left up to the discretion of the detective, and it could open the door to corruption or extortion," Espino del Castillo said.
Anyone caught with drug amounts under the new personal-use limit will be encouraged to seek treatment, and for those caught a third time treatment is mandatory.
The maximum amount of marijuana for "personal use" under the new law is 5 grams — the equivalent of about four joints. The limit is a half-gram for cocaine, the equivalent of about four "lines." For other drugs, the limits are 50 milligrams of heroin, 40 milligrams for methamphetamine and 0.015 milligrams for LSD.
Mexico has emphasized the need to differentiate drug addicts and casual users from the violent traffickers whose turf battles have contributed to the deaths of more than 11,000 people since President Felipe Calderon took office in late 2006.
But one expert saw potential for conflict under the new law.
Javier Oliva, a political scientist at Mexico's National Autonomous University, said the new law posed "a serious contradiction" for the Calderon administration.
"If they decriminalize drugs it could lead the army, which has been given the task of combating this, to say, 'What are we doing?' " he said.
Officials said the legal changes could help the government focus more on big-time traffickers.
Espino del Castillo said since Calderon took office, there have been over 15,000 police searches related to small-scale drug dealing or possession, with 95,000 people detained — but only 12% to 15% of whom were ever charged with anything.

That any law enforcement agencies and entities can and will be sued to the tune of $60,000 per person,  for each violation of the law, as they are required to uphold the laws that they are sworn to protect.
Our government must stop playing with a deck that is stacked against its own citizens. With this in mind, the Tea Party does not represent oppression, tyranny, or enslavement that exists in this world in various forms; the Tea Party is America, Commerce, and Freedom. In the interest of preventing the first three aforementioned and to preserve the last three as the latter is stated, the Tea Party hereby reclaims our full rights as afforded to us by the Constitution.
In an effort to reduce the number of deaths from prescription pills and to squelch profiteering from addiction and disease, the Tea Party pledges to not support destructive behavior, and to report it dutifully in the best interest of preservation of life, liberty, and happiness. While the Tea Party does not wish to nanny, we also do not wish to nurture or encourage life-threatening behavior or lifestyles, we will not remain silent to the demise of others!
Prescription pills have in recent years claimed the lives of some of the most beautiful, brilliant, and unique individuals of our time: Heath Ledger, Anna Nicole Smith, and many others who sought help and relief and got death in return. May God forgive us if there was anything that we could have done to spare the thousands upon thousands who have died: well over 25,000 lives in recent memory, more than Iraq and Afghanistan wars combined.
Is it any wonder other countries mock our freedom, when our government has trod upon us and squished us like grapes, drunken with gluttonous greed from the power struggle from the War on Drugs? No longer does the Tea Party accept these limitations unlawfully imposed upon us, as the emerging Third Party, and we will no longer be surmised as the “silent or not-so silent Majority”, whose voice has been sold to representation of minority and special interest groups by way of seats, with political corruption and banking schemes! We hereby declare our freedom from tyrannical government, by our rights reserved from and by the Constitution of the United States! From this day forth, we are not expected to follow or observe laws and regulations that infringe upon our rights as citizens, in the interest of free and secure government. We stand for nothing less than this!
Anyone who stands for this may cite this as a legal document, in conjunction with other Patriotic documents, to support their position as a citizen under what has been penned here as “The Tea Party Treatise”. Statement from Sen. Buddy Carter on General Assembly Passing Patient Safety Act

ATLANTA (April 14, 2011) – State Sen. Buddy Carter (R-Pooler) released the following statement Thursday after the Georgia General Assembly approved the Patient Safety Act of 2011 (Senate Bill 36). Carter authored SB 36, a bill that aims to help Georgia doctors and pharmacists curtail prescription drug abuse in the state. The Act would create an electronic database of all controlled substances dispensed in Georgia pharmacies over a one-year period.

“Today we can finally say that Georgia will no longer be a safe haven for illegal “pill mills” and controlled prescription abuse. Almost every other state in the nation already has some sort of monitoring system in place to track potential controlled substance prescription abuse. Every state surrounding Georgia has electronic databases that can identify and stop illegal activity concerning controlled substances, making our state a prime location for this epidemic to rise. In 2008 alone, out of the 640 drug overdose deaths in Georgia, 540 involved legal prescriptions.”

With the passage of the Patient Safety Act, doctors and pharmacists around the state now will have the right tools to effectively crack down on prescription drug abuse in our state, prevent illegal activity, and most importantly help save lives. I want to thank the General Assembly for their support of this important and long-overdue legislation and I now look forward to working with Governor Deal to get the Patient Safety Act signed into law.”

Final changes include measures that restrict other states’ access to Georgia’s database, moving the database to one year of prescription records, increasing identification requirements for persons retrieving prescriptions for other patients, and making sure all Schedule II drug prescriptions are placed on security prescription paper.

SB 36 now heads to Governor Deal for his signature.

Obama Plan Makes Social Security Look Like Welfare

Who poses the biggest threat to destroy Social Security? President Barack Obama.
In December 2010, Obama signed a tax deal with his provision for a one-year, 2 percent Social Security payroll tax holiday. It lowered workers' payroll deductions from 6.2 percent to 4.2 percent in 2011. This year, Obama proposed increasing the tax holiday for another year, with workers paying half the old rate -- 3.1 percent -- as part of his American Jobs Act. According to the White House, a typical family earning $50,000 a year could expect to save $1,500.
Obama deftly co-opted the argument that Republicans successfully have used to extend the Bush tax cuts. Last month he argued that if Washington fails to extend the 2011 tax cut, "middle-class families will get hit with a tax increase at the worst possible time."
Clever.
The president also proposed halving the employer contribution to 3.1 percent for an employer's first $5 million in wages and waiving the full freight for some new hires. Add it all up and Obama wants to cut Social Security payroll taxes by $240 billion next year.
First Washington raided the Social Security trust fund to pay for increased spending. Now Washington is raiding the trust fund to pay for tax cuts.
Stanford University economist John Taylor, who has been an adviser to John McCain, studied the temporary tax cuts proposed to stimulate the economy under George W. Bush and Obama. "These are, at best, short-term boosts, which disappear quickly," Taylor told me, and they "don't reduce the unemployment rate."
Economist Will McBride of the Tax Foundation also believes that the Obama plan would not provide the needed job stimulus. He noted that in 2010, the Social Security fund started paying out more than it takes in. Slashing revenue "just exacerbates that problem." McBride fears that if the Obama jobs bill passes, "Moody's and Fitch will downgrade us (the U.S. credit rating), as well as S&P."
The White House promises that "Social Security will still receive every dollar it would have gotten otherwise." Oh, joy, another IOU.
Be afraid. If a one-year tax holiday becomes a bigger two-year tax holiday, it could snowball. Rep. Peter DeFazio, D-Ore., fears that the cut will be renewed in perpetuity. "If this becomes permanent, then Social Security would be exhausted in 2021, instead of 2037," DeFazio told the Washington newspaper The Hill. DeFazio wants to increase payroll taxes on incomes higher than $250,000 -- the current cap is $106,800 -- to fully fund Social Security. Now, I think DeFazio's proposal would poison any economic recovery -- but at least he is thinking about the fund's solvency.
House Budget Committee Chairman Paul Ryan predicts that the Obama plan could change the way Americans look at Social Security. At the Hoover Institution last week, Ryan told me that if Washington "de-links Social Security's financing from labor and reward -- from payroll taxes to benefit -- we're risking changing the social-insurance nature of the program and turning it into a welfare program."
Close to 40 percent of Americans pay no federal income taxes.





Now Obama wants to halve the only payroll tax they pay. That would leave a bigger tax burden on those who do pay federal taxes. And yes, Social Security would start looking like welfare.

Clayton police burn $12M in drugs

Clayton County police burned more than $12 million worth of drugs that had accumulated in the departments crowded evidence room, authorities said.

Police received a court order from a Superior Court judge to allow them to burn nearly 10,000 pounds of marijuana, crystal meth and other assorted narcotics, Clayton County police spokeswoman Lt. Tina Daniel said.

"This is in response to the audit of the police department," Daniel said.

As part of a scathing indictment of former Police Chief Jeff Turner's management of the department, county Chief of Staff Alex Cohilas cited a narcotics evidence room that was "in shambles."

The burns happened on two different occasions, last week and Tuesday, in an undisclosed, secure location, Daniel said.

"This is just a small part of the police department's aggressive efforts to fight illegal drug use and sales in Clayton County," police chief Timothy Robinson said.

The burn was done with the aid of the Clayton Fire and Emergency Services, the Clayton County Sheriff's Office and the Clayton County District Attorney's Office.

The Methamphetamine 6 and the end of politics as usual

Voters in north Georgia had tired of politics as usual. They demanded something different.

Now they have it — a 9th District congressional race that, instead of ending on Tuesday, will go on and on like a painful but riveting summer soap opera.

The featured player is certain to be former state House member Tom Graves of Ranger, whose lush black hair, easy manner and tea party credentials made him the man to beat in a May 11 special election to fill out the final six months of former congressman Nathan Deal’s term.

Graves walked away with 35 percent of the vote. Odds are good that he’ll win the Tuesday runoff against former state senator Lee Hawkins of Gainesville, a dentist.

Under normal circumstances, the fairy tale would end there. Graves’ defeated opponents would gracefully exit — offering only token, underfunded resistance leading up to a July 20 primary and a full, two-year term in Congress. (No Democrat remains in the contest.)

But we are done with politics as usual, and have shifted to politics of the bizarre — courtesy of an extended-stay motel in Calhoun, nicknamed by its current proprietor as the Methamphetamine 6. In honor of the habits of its clientele.

At the crack of Memorial Day weekend, news broke of a lawsuit filed by the Bartow County Bank, which alleged that Graves and Senate Majority Leader Chip Rogers (R-Woodstock) had defaulted on a $2.2 million loan used to purchase the establishment.

The business case for the Oglethorpe Inn is unclear. But Georgia offers some tasty tax breaks for on-scene movie companies, and perhaps a series of slasher flicks was contemplated.

The 32-year-old motel and debt, Rogers and Graves say, now belong to another company owned by a fellow who wears an electronic monitor on one ankle.

Moreover, Rogers and Graves accuse the bank of reneging on a deal. The bank allegedly made a promise to two sitting state lawmakers — Graves resigned his seat this spring — that it would convert the obligation to a 2.5 percent, interest-only loan. On $2.2 million.

The most damaging feature of the lawsuit is the bank’s accusation that Graves fraudulently transferred two properties — including his residence in Ranger — to a trust in an attempt to frustrate the bank’s efforts to collect on the debt.

Graves supporters say times are hard everywhere, but especially in north Georgia — where real estate has plummeted like a red-tailed hawk on a doomed pigeon.

Graves denies any wrongdoing. “This country has a judicial system in place where business disputes like this lawsuit can be successfully and fairly resolved,” he said.

But the crucible of Washington is not famous for patience.

Assume a Graves victory next Tuesday. His supporters are enthusiastic, and last-minute developments rarely have a significant impact on campaigns.

Graves will be sworn in as soon as the vote is certified. Just as quickly, a complaint against him — third parties can be found, so the author does not matter — will be lodged before a congressional ethics committee to force a speedy assessment of the facts.

Which means that regardless of what happens Tuesday, many of the combatants of the 9th District will refuse to leave the field.

Hawkins took 23 percent of the vote last month. In a statement issued Wednesday, the former senator would not concede defeat in next week’s balloting . But he added this: “Mr. Graves has obviously used some very bad judgment in his financial dealings, and that controversy now apparently won’t end on Tuesday regardless of who wins.”

Likewise, Steve Tarvin of Dalton, a self-made textile executive, declared Graves’ financial situation “unfortunate,” but said he would not withdraw. Tarvin won 15 percent of the vote in May.

“I’m in it. I feel like I’m the true heart of the 9th District. I feel like in July, it’s going to be a different story,” Tarvin said. Of seven candidates who signed up for the July 20 contest, only two have said they would withdraw.

But none have sent the necessary notarized statement to Secretary of State Brian Kemp. As of now, all seven names will appear on the Republican ballot — a near guarantee that a runoff will push the soap opera into August.

The contest is already forcing signs of a split within Georgia’s Republican delegation.

Graves has the support of U.S. Rep. Lynn Westmoreland of Coweta County. But U.S. Rep. John Linder this week accused Graves of lying about the amount of campaigning he’d done on behalf of the Fair Tax.

Kate Monaghan, communications director for the Graves campaign, said her candidate expected a strong showing on Tuesday, equal to the vote in May. And she pointed out that U.S. Rep. Eric Cantor of Virgina, the House minority whip, endorsed Graves this week.

Monaghan singled out the dentist in Gainesville — the population center in the district is weighted toward that city — for criticism.

“Regardless of how much mud Lee Hawkins throws, the voters want a candidate who will not compromise when it comes to cutting taxes, opposing wasteful Washington spending, and creating jobs for Georgians,” she said.

  • Frankie Gibehart is a convicted felon, in possession of a shotgun and pistol, according to eyewitness accounts/source will remain unnamed, as several neighbors are complaining that they hear him abusing his wife whose name is Carol.
  • Carol had surgery last year, and Frankie punched her in the stomach, which resulted in a staph infection. Those who visited Carol and Frankie contracted staph, including staph being spread to Megan Coursey/McDaniel(s) daughter Brooke, and Terry and Amanda Lucas. The staph was spread around to Ponderosa, with people who washed their hands still getting staph in their respiratory tract. (Frankie remarked to ambulance workers that Carol was not sick enough to where she couldn't walk her fat @ss to the ambulance on her own --- :( ).
  • Neighbors witnessed Frankie burying a black man's body under a pile of shingles in his yard, (the body should still be there, unless it has been moved) but they have been too fearful of him because he brags about this to people/to discourage them to report this to law enforcement, as it is known that Duncan is so scared of Frankie himself, that when he pulled him over for DUI, he simply followed Frankie home and did not charge him with DUI.
  • Neighbors are also tired of Frankie threatening them over his dogs, he owns 9, and even though Animal Control has been out there, they have not taken the dogs into custody for Frankie failing to restrain them. When anyone walks by the property, and these dogs are out, these two from the pack of 9 dogs charge the road after pedestrians:

Three different sets of neighbors have complained to me since Christmas of 2010 that the Spalding County Sheriff’s Department refuses to heed their concerns regarding a house that they have reported at various times for the following concerns: unrestrained dogs that have bitten children that cross the road and trespass onto neighboring properties that appear to have mange/not fed on a regular basis, septic tank has no cover, property was previously cited for trash and waste against County codes, Frankie beating Carol numerous times, and Richard being a convicted sex offender not listed on public registry due to loophole in the law when incident occurred before registration was required.

*Neighbors allege that Dee Stewart refuses to prosecute Frankie for drunk driving; they allege that they drive a red truck, a blue truck, and a silver vehicle without proper licensure, tag, or insurance. They insist that their tag sticker was stolen from their vehicle because of this.
*Neighbors allege that there is a body of a dead black man buried under a stack of shingles on the property.
*Neighbors also allege that Carol engages in bestiality, and that she was caught sexually compromised with a dog in their bathroom by Frankie.
*Neighbors names will remain anonymous for fear of retaliation, as Frankie has threatened violence against them before, and they have been under duress.
*Neighbors allege that as recent as Sunday afternoon 4/3/2011 after 2pm, CASH-FOR-CARS 404.374.8926 unloaded 6 cars onto the property, some in working order/some not:

-Frankie Gibehart receives a Social Security check even though he works, and he receives food stamps, and he takes his brother Richard Gibehart’s food stamps in lieu of rent or payment for drugs. Frankie is paying his probation by these means, paying back the system with its own money.

-Carol Heybye was most recently incarcerated for 2 weeks in Henry County, then 30 days for failing to do her community service as ordered by the court/was cited for improper tag, no license, no insurance.


-They have been known to consort with crack cocaine dealers (named ******* ) and do prescription pills. Someone overdosed in their home. Carol committed insurance fraud by doctor shopping, claiming 2 prescriptions for pain pills on her insurance, and has been banned from being written any prescriptions for pain pills based on her insurance company’s suspicion that she was selling prescription pills without a license/for personal profit:

were arrested April 8 on numerous drug- and weapons-related charges after the execution of a search warrant at 1578 Patton Road Lot 68.

Thursday Mornings Storm Destroyed Spalding County Home

GRIFFIN, Ga. -- An EF-3 tornado hit Spalding County and that's where an incredible story of survival comes for the daughter of a sheriff's deputy. The walls came down around the13-year-old and the wind literally pulled her out of her home.

“It just kind of turns your stomach to see this because not even 24 hours ago everything was fine, everybody was happy,” said the girl's brother, 16-year-old Corey Peavy.

Everything changed in an instant for the Peavy family. As they sift through what's left, they recall what happened.

“By the time I heard the noise, it was too late. We didn't have enough time,” said mom Stacey Peavy.

The storm early Thursday morning decimated their house. The roof ripped off, walls fell down and their van was bulldozed by the winds. The family said the scariest moment came when 13-year-old Kylie was flung outside.

“My windows started busting open and my wall like, like, fell over,” said Kylie Peavy.

“When I got into her room and the walls went up, I yelled for her and I just heard her scream, ‘Mommy, mommy,’” said Stacey Peavy.

“And I just got like, slung out. When I fell outside, everything started falling over and it was a whole bunch of stuff,” said Kylie Peavy.

Stacey said she somehow pulled Kylie inside.

“We got to my husband because he couldn't get to us and we hid in our closet and waited,” said Stacey Peavy.

When the storm passed, their home was unrecognizable. Corey Peavey said despite losing his home, he's thankful.

“It was a miracle my sister came out, I mean I was scared she wouldn’t,” said Corey Peavy.

“We’re hanging in there. All of it can be replaced, my kids can't,” said Stacey Peavy.

I'm glad that God spared the Peavy family. May they take it as a divine warning not to shake hands with those who are currently being used as the devil's helpers! You see what happened to Ponderosa and elsewhere; God is not mocked, for whatever a man sows he also reaps. Drug addiction takes what most people own in worldly possessions, but it takes the 10% that is set apart for God. When law enforcement makes deals with people who are addicted to drugs, who worship it as an idol and who can't stop, drug addiction destroys communities and destroys people spiritually. Now you see the war in the spiritual realm reflected in the natural, with the covering of protection removed from this area, of people who posted there to pray. Partying is not everything; especially when you don't want to see your friends die of an overdose when they are like family to you. God can restore everything to the Peavy family, but I pray that this only strengthens their faith in what they can not see. 4-28-11 was an 11yr. anniversary that I almost died so it was already a day with bad significance for me, but God spared my life then, and he spared it again last night. 200 deaths could've been 2,000, easily 20,000: had no one heeded my emails, texts, and messages from the ridge before it hit Griffin. Everything happens for a reason, and I pray that the Peavy family heed it for the warning that it is.

Best news all day, I just found out: I just couldn't live with myself having someone accused of something just because they wanted to do music together and someone got jealous and sent the cops to their house! I have tears streaming down my face, this is a great day! Thank you for keeping your faith Waka, I'm sorry the cops said those things to your Momma, I hate what Lanny did to Robert and to you and Gucci. I'm glad that you did not resist or talk back, it could've been so much worse: HCPD have been known to be @ssholes, to treat you as if you're guilty and you have to prove your innocence. They dropped the charges, because they didn't want you to sue for them obtaining evidence by use of the poisonous tree. I am so glad you kept your faith, I knew it the whole time!!! :D

Joyce Daly, mother of slain Clayton County Sheriff's Deputy Rick Daly, is pictured with three of her son's former co-workers Friday at the Georgia Sheriffs' Youth Homes office in Stockbridge.
#The mother of a Clayton County sheriff's deputy killed in the line of duty in July said Friday her son would be pleased to see something positive come out of such a senseless tragedy.
#Deputy Rick Daly's family attended a presentation of donations from employees at DHL to the Georgia Sheriffs' Youth Homes. His mother, Joyce Daly, spoke on behalf of his wife, Cheryl; son Fayette sheriff's Lt. Toby Daly; daughter Amber Wright; and sisters Suzanne Brown and Judy Dempsey.
#"These kids are our future," she said. "If we don't help them, who will? What better way to honor his memory. He loved kids. He's happy today if he can see us down here."
#Daly is the first countywide officer in Clayton to die by gunfire in the line of duty. Police have charged Veasna Johnathan Bun, 17, with murder in his death. Joyce Daly said she sees parallels in the lives of the children in the youth homes and Bun.
#"Some of these kids could've ended up like Johnathan Bun," she said. "Who knows what would have happened if he'd had more help? I wish there had been more done for him. He's just a kid."
#The Georgia Sheriffs Youth Homes have provided stability, security and structure to the state's at-risk children for more than 50 years. They are sustained through community and corporate donations, said Terry Norris, executive director of the Georgia Sheriffs Association and the youth homes. The Daly family has asked donations for Georgia Sheriffs' Youth Homes be made in lieu of flowers for anyone wanting to honor Daly's life.
#Friday's donations of money and household, personal and school items were coordinated by the worldwide shipping corporation, DHL, as part of the company's Global Volunteer Day. Daly's sister, Suzanne Adams, has worked for DHL for 23 years.
#"They really went above and beyond," said Adams. "For them to do this for me, it's just wonderful."
#Adams said the family has been overwhelmed by support since her brother was killed, so it was important for them to return the generosity.
#"It's exciting that our family can give something back to show our appreciation," she said. "Kids are so important. Rick would have loved this, to honor his memory in this way. We want to keep doing good things and not let it be a tragedy. He'd be the first one to help if this had happened to another officer."
#Sumter County Sheriff Pete Smith is president of the Georgia Sheriffs' Youth Homes. He told the group Friday that here is nothing in those boxes that the kids can't use.
#Clayton sheriff's Chief Deputy Garland Watkins spoke for his department.
#"This was an unfortunate tragedy, but we can get past it and we'll get past it together," he said. "We lost him, but isn't it grand what he's still able to do?"

As always, my family comes first and obviously Todd and I put great consideration into family life before making this decision. When we serve, we devote ourselves to God, family and country. My decision is based upon a review of what common sense Conservatives and Independents have accomplished, especially over the last year. I believe that at this time I can be more effective in a decisive role to help elect other true public servants to office.

Soros-Backed Voting Study Promoted By Soros-Funded Media

Once again the media is completely ignoring the fact that an initiative it’s covering was funded by left-wing financier George Soros. The Soros-funded Brennan Center for Justice released a report opposed to new laws needed to combat voter fraud. This story was in turn promoted by Soros-funded progressive news sites that brought it to the national stage.
The Brennan Center for Justice, part of New York University’s Law School, reported that voting law changes “could make it significantly harder for more than five million eligible voters to cast ballots in 2012.” This 64 page report went on to explain that the effects “fall most heavily on young, minority, and low-income voters, as well as on voters with disabilities” and that the “wave of changes may sharply tilt the political terrain for the 2012 election.”
None of the five stories by The New York Times, Washington Post, Wall Street Journal, USA Today, or CBS News noted that this study was funded by Soros. However, when the Koch Brothers fund a libertarian or conservative initiative the media tend to make note of it.
Each outlet had one story on the topic, but only CBS News said the Brennan Center for Justice as a “the liberal think tank” which the other stories failed to say. The Wall Street Journal did imply it when they said the Center was “named after the liberal Supreme Court justice William Brennan.” These articles did include liberal and conservative views, such as The New York Times which said “Republicans, who have passed almost all of the new election laws, say they are necessary to prevent voter fraud” and a quote from the Heritage Foundation.
The story first showed up in a preview by The New York Times on Oct. 2. The findings then made the rounds on liberal blogs and were written up by other outlets. This Soros-funded report was then promoted by the Soros-funded lefty media, which reaches more than 300 million people every month.Members of the Media Consortium, which received $425,000 from the Open Society Foundations, pushed the story when it first broke.
The Nation article was titled “GOP Voting Laws Could Swing the 2012 Election” and described “The GOP War on Voting.” The Nation Institute received $77,000 from the Open Society Foundations since 2000, on top of being a member of the Media Consortium. ColorLines said the report “puts forth an ominous prediction.” AlterNet linked to a Loop21 article subtitled “New voting restrictions try to ensure President Obama is a one termer.”
Other members followed a similar tune. Campus Progress said “the report paints a troubling picture,” while Think Progress just said there were a “slew of GOP-backed laws that restrict voting rights” These two blogs are both part of Democrat John Podesta’s Center for American Progress, which took in $7.3 million from the Open Society Foundations.
As the Business & Media Institute has reported, a study by the Media Consortium detailed how progressives had created an "echo chamber" of outlets "in which a message pushes the larger public or the mainstream media to acknowledge, respond, and give airtime to progressive ideas because it is repeated many times." According to the report called "The Big Thaw," "if done well, the message within the echo chamber can become the accepted meme, impact political dynamics, shift public opinion and change public policy."

Quinnipiac: 77% of Voters Say We’re in a Recession

American voters disapprove 55 – 41 percent of the job President Barack Obama is doing, an all- time low, and say 77 – 20 percent that the economy is in a recession, according to a Quinnipiac University poll released today.
Voters say 44 – 11 percent that the economy is getting worse, not better, while only 29 percent say the economy will improve if the president is re-elected. Voters also disapprove 48 – 34 percent of the way Obama is handling the Israeli- Palestinian dispute. The president should be a strong supporter of Israel, voters say 63 – 20 percent, but they split 39 – 40 percent on whether Obama is a strong supporter, the independent Quinnipiac (KWIN-uh-pe-ack) University survey finds. The Israelis and the Palestinians are equally to blame for the failure to achieve Middle East peace, 64 percent of American voters say, while 22 percent blame the Palestinians and 6 percent blame the Israelis.
“The trend isn’t good for President Barack Obama. His disapproval has gone up 9 points since the summer, from 46 percent in July to 52 percent in September to 55 percent today,” said Peter A. Brown, assistant director of the Quinnipiac University Polling Institute. ”Especially troubling for the president is that voters say 49 – 39 percent thatRepublican presidential contender Mitt Romney would do a better job on the economy. GOP contender Rick Perry would do only slightly better, voters say, and Republicans in Congress would not be much better.
I originally wanted to write the headline, “Obama Disapproval Hits New High, Again,” but I realized I wrote that one two days ago. Different poll, same results.


Poll: Voters fear worse economy with Obama

President Obama not only has a political problem with the economy, but with voters' confidence in his ability to handle it.
By a margin of 44-11%, voters say the economy is getting worse, not better, according to a newQuinnipiac University poll -- and only 29% say the economy will get better if Obama is re-elected.
The Quinnipiac poll also says that voters believe Republican presidential candidate Mitt Romney would do a better job on the economy than Obama, by a margin of 49-39%; Rick Perry gets the nod over Obama by a margin of 45-42%.
Overall, visitors disapprove of the job President Obama is doing, by a margin of 55-41%.
"The trend isn't good for President Barack Obama," said Peter A. Brown, assistant director of the Quinnipiac University Polling Institute. "His disapproval has gone up 9% since the summer, from 46% in July to 52% in September to 55% today."
Some good news for Obama in the Quinnipiac poll: More voters continue to blame predecessor George W. Bush for the state of the bad economy, by a margin of 51-32%.
"The political challenge for the president will be whether he can make voters believe his eventual GOP opponent is a carbon copy of the former president," Brown said. "The fact that voters are unsure whether the economy will improve if he is re-elected is not a good sign for Obama."
Brown also said: "The president is stuck at a politically unhealthy level for someone who wants to be re-elected. His standing with the American people is obviously closely related to their views of the economy."
More from the new Quinnpiac poll:
The president's job approval among Democrats, 77-18%, is lower than his disapproval among Republicans, 91-7%. Independent voters disapprove 56-38%.
Men disapprove 60-36% and women disapprove 51-46%. Black voters approve 81-15%, but disapproval is 62-34% among white voters and 50-45% among Hispanic voters.

A Plan to Limit Dishonesty in Congress

Give two U.S. Senators credit for trying to do something about the smoke-and-mirrors games in Washington.
The “Honest Budget Act” by Sen. Jeff Sessions (R-AL) and Sen. Olympia Snowe (R-ME) goes to the heart of public distrust of Congress, namely the dishonest budget gimmicks and accounting tricks.
The public is rebelling because too many “budget cuts” have turned out to be spending increases or, at best, promises that a future Congress will curtail spending.
By no means does the senators’ legislation fix all the problems, but it’s definitely a good start.  They take aim at what they calculate are $350-billion in gimmicks used during recent years, by both political parties.  Their checklist includes:
–No budget, no spending. It’s been over two years since the Senate has adopted a budget plan.  The proposal is to prevent any new spending whenever an overall budget has not been approved by Congress.
–Quit crying wolf. So-called “emergency spending” is exempted from budgetary limits, so they propose that any claimed emergency must have supermajority approval.  (As Heritage has noted, “routine expenditures [are] given the emergency designation simply to evade spending caps.”)
–No phony piggy bank raids. We have hundreds of billions in unspent money that was appropriated in prior years–$703-billion was the total at the start of fiscal year 2011.  Rather than canceling those old, unused and unnecessary obligations from prior years, Congress re-directs them to new spending that is then exempted from normal spending limits.  The proposal would curtail the practice.
–A freeze should be a freeze. Remember President Obama’s claims last year that federal workers’ pay has been frozen for two years?  The claim is phony, because of backdoor “step increase” adjustments that have averaged 2-3% increases. Under the plan, those would be frozen until 2013.
–No time games. Billions of dollars of revenue and spending have been “deemed” to occur a day earlier or later, so that they’re credited to a different federal fiscal year.  The IRS won’t let taxpayers ignore the actual calendar, so Congress shouldn’t either.
The Sessions-Snowe plan is good.  As they say, the goal is, “No more gimmicks, tricks, or empty promises. America deserves an honest budget.
Their plan will not, however, curtail all of Washington’s huge bag of tricks.  Many more are described in a Heritage guide, “Things You Never Knew About Appropriations—But Should.”
And even if Congress fixes its process, that won’t fix the rhetoric—the false claims that are routinely made about the contents of spending bills.  But the longest journey begins with a single step, and the senators’ plan would start that journey on the right foot.

Potato Lobby Turns Up The Heat In School Lunch Battle

When the potato lobby speaks, it always puts its best spuds forward. Yesterday at a National Press Club lunchtime briefing to promote the nutritional value of the vegetable, that meant a full bar of baked potatoes, french fries (baked, not fried), sour cream, cheddar cheese, chopped tomatoes, spinach and broccoli. Yes, according to sources close to the food, it was scrumptious.
The group, which has been fighting the U.S. Department of Agriculture's proposed school nutrition guidelines to limit white potatoes and other starchy vegetables to 1 cup a week, rolled out some big guns today, in the form of lunch ladies, to butter up the press.
The National Potato Council released a survey of 245 school food service directors showing how most think the new rules would lead to higher costs, more wasted food, and lower participation in the school lunch program.

Schools are looking for healthier ways to prepare food. "Today's school lunch is not your school lunch you remember," Dayle Hayes, a registered dietician, said at the briefing.
The keynote speaker at the National Potato Council event, Sen. Susan Collins, R-Maine, didn't stop for a bite, even though her home state is one of the biggest producers of potatoes. She said she had other plans for lunch.
Collins has been giving the potato lobby her time all year. She'sspoken out frequently against the USDA's proposal.
Agriculture Secretary Tom Vilsack told The Salt recently, the move is an effort to reduce the amount of french fries kids eat and clear a space for other vegetables, like carrots or green beans.
The proposed limits don't sit well with Collins. "This means if a school serves a medium baked potato on a Monday it could not serve a full serving of corn or more potatoes for the rest of the week," she said. "That makes no sense whatsoever." She has vowed to strike the USDA's potato language when the agricultural spending bill reaches the Senate floor.
Collins and other potato supporters stressed the nutritional value of the spud, including potassium and dietary fiber. They also said potato bars, which are growing more common in public schools, help entice kids to eat other vegetables and important foods like low fat cheese and broccoli and spinach.
And those oft-maligned french fries? the council says only 10 percent of schools even have a fryer today.
A final ruling from the USDA is expected early in 2012 — and Vilsack says the department is taking into account the concerns that have been raised about potatoes.
Collins noted she and her five siblings ate some type of potato almost every day growing up in rural Maine, and none of them are overweight.

Senate Democrats add millionaire tax to jobs bill

WASHINGTON (AP) - Struggling to deliver the big jobs package proposed by President Barack Obama, Senate Democrats are using the issue to force Republican senators to vote on tax increases for millionaires, picking up on a White House theme that the nation's wealthiest Americans aren't paying their fair share.
Senate Majority Leader Harry Reid, D-Nev., said Wednesday he is changing Obama's jobs package to add a 5 percent tax on income above $1 million, a proposal that is sure to be blocked by Republicans.
The $447 billion package still includes Obama's proposals to cut payroll taxesand provide money for teachers, firefighters, the unemployed and infrastructure. The tax on millionaires is expected to pay for the package, so it wouldn't add to the budget deficit.
Democrats are banking on Republicans to oppose both the higher taxes on million-dollar earners and the president's call for new spending aimed at reducing joblessness, leaving them open to a charge of protecting the wealthy at the expense of the unemployed.
"Republicans will be hard pressed to explain why they allowed teachers and firefighters to be laid off, rather than have millionaires and billionaires pay their fair share," said Sen. Chuck Schumer, D-N.Y. "Republicans will struggle to defend putting off repairs to crumbling schools in order to protect tax breaks for the wealthiest 1 percent of America. This is the contrast that will be on display in the Senate next week."
Reid said he plans to bring the bill up for a vote in the Senate next week, though without Republican support, it won't get the 60 votes needed to advance. Republican leaders said they won't support tax increases, even on the wealthy, because they would hurt an already weak economy.
"I understand our Democrat friends want to jettison entire parts of the bill altogether—not to make it more effective at growing jobs, not to grow bipartisan support," said Senate Republican leader Mitch McConnell of Kentucky. "No, they want to overhaul the bill to sharpen its political edge."
The new 5 percent tax would be applied to adjusted gross income above $1 million—that's income before itemized deductions are subtracted—including income from capital gains and dividends. The top tax rate on earned income is currently 35 percent. The top capital gains tax rate is 15 percent.
The tax increase would raise about $450 billion over the next decade, paying for the entire jobs package, Reid said. It would take effect Jan. 1—a year earlier than the tax increases in Obama's original package.
Obama has said raising taxes during a weak economy is not a good idea and, campaigning for his jobs bill in Cincinnati last month, he made a point of noting that his tax increases would not kick in until 2013. "Nobody is talking about raising taxes right now," he said.
On Wednesday, White House press secretary Jay Carney said he was not familiar with details of the Senate Democratic plan and would not comment on the specific timing of the millionaire surtax. But he added that "if we have to make choices here, that this trade-off is an acceptable one whenever the revenue increases kick in because of the urgent need we face to address an economic problem."
Democratic leaders in Congress point to recent polls showing support for increasing taxes on the wealthy.
A Washington Post-ABC News released this week said 75 percent of respondents supported raising taxes on Americans with incomes over $1 million a year. That same poll found that 52 percent of respondents supported Obama's jobs package, and 36 percent opposed it.
Sen. Orrin Hatch of Utah, the top Republican on the Senate Finance Committee, recalled that previous proposals to raise taxes on millionaires had failed, with some Democrats joining Republicans in opposition.
"Some of my Democrat colleagues were right to reject a similar proposal when they controlled both chambers of Congress," Hatch said. "Given the weak state of our economy, they'd be wise to reject it again."

LOS ANGELES (Reuters) - Disturbing sounds and images from Michael Jackson's life and death played a key role on Wednesday in the manslaughter trial of his doctor, with jurors hearing a recording of the self-styled King of Pop speaking in a slurred voice and viewing a photo of his dead body.
Prosecutors also showed pictures of a jug of urine found by Jackson's bed after his June 25, 2009 death, and a coroner's investigator testified she found a large collection of sedatives and painkillers in the "Thriller" singer's room.
A recording of a May 2009 conversation between the singer and his physician, Dr. Conrad Murray, marked one of the most dramatic moments in the doctor's week-old trial on charges of involuntary manslaughter.
Jackson is heard speaking slowly, in a low and at times incoherent voice, slurring his words.
"My performances will be up there helping my children and always be my dream," Jackson said.
"I love them because I didn't have a childhood. I had no childhood. I feel their pain."
"Elvis didn't do it. Beatles didn't do it. We have to be phenomenal," Jackson is heard saying of his planned 50 London comeback concerts. He said he wanted to use the profits from the shows to fund a children's hospital.
Jackson's brother Jermaine Jackson wiped away tears while listening to the tape.
Prosecutors are seeking to prove through the tape Murray knew the powerful effects of the drugs they claim he was giving Jackson, well before the singer died in his care.
Murray denies involuntary manslaughter -- or criminal negligence -- in Jackson's death from what medical examiners have said was an overdose of the powerful anesthetic propofol combined with sedatives.
The doctor has admitted giving Jackson propofol that day as a sleep aid. But his attorneys claim Jackson gave himself an extra, fatal dose of propofol when Murray was out of the room.
Coroner's investigator Elissa Fleak testified on Wednesday she found a large collection of drugs and medical paraphernalia scattered through Jackson's bedroom and an adjoining walk-in closet. They included vials of propofol and the sedative lorazepam.
There were also other drugs in a wicker basket beside Jackson's bed that were prescribed by doctors other than Murray. Some bottles were made out to "Mick Jackson" or "Omar Arnold."
Fleak said it was she who took a photo of Jackson lying dead on a hospital gurney that was shown to the jury on Wednesday.
Murray faces a maximum of four years in prison if convicted.

Bachmann: Social issues receiving ‘virtually no’ attention

Republican presidential contender Rep. Michele Bachmann (Minn.) said she took time this week on the campaign trail to focus on social issues, claiming that those concerns are being ignored by many candidates.
The congresswoman told Fox News she was highlighting her views on abortion, marriage and family because there has been "virtually no" conversation about these topics in the GOP race.
"We can't forget that in the midst of the number one issue that the campaign will be about, which is jobs and the economy, which it should be, we can't forget that there's another group of issues that are very important for a lot of voters," said Bachmann on Fox News's "On the Record with Greta Van Susteren." "That's the pro-life issues, marriage, family, faith, religious liberty."
Bachmann said she was meeting with the faith community in Iowa to let voters know where she stands on these issues.
During the interview Bachmann praised Apple co-founder and chairman Steve Jobs, who died Wednesday at age 56.
"To lose him is to lose a part of American genuis," said Bachmann.

"He was such a unique thinker and to lose him there isn't really replacement for him. I think we all saw the demise was coming, but when it came it was a very sad moment," she added.
An icon of American business on par with Henry Ford and Walt Disney, Jobs left a permanent imprint on the development of consumer technology.


"Steve was among the greatest of American innovators - brave enough to think differently, bold enough to believe he could change the world, and talented enough to do it," President Obama said in a White House statement.

TUESDAY, Oct. 4 (HealthDay News) — Obesity and alcohol consumption are among the leading causes of sudden cardiacdeath not caused by coronary artery disease, a new study finds.
Researchers analyzed data from autopsies of almost 2,700 people in Finland who died of sudden cardiac death — in which the heart abruptly stops beating and death occurs rapidly — between 1998 and 2007, along with the patients' hospital records and questionnaires completed by their relatives.
Coronary artery disease was deemed to be the cause of death in 78 percent of cases, while causes unrelated to coronary artery disease were found in about 22 percent, the University of Oulu researchers said in a journal news release.
Coronary artery disease is a narrowing of the blood vessels that bring blood and oxygen to the heart, caused by a buildup of plaque on the arterial walls.
Of the deaths not related to coronary artery disease, the most common underlying cause of death in people younger than 40 was fibrotic cardiomyopathy (28.3 percent). Cardiomyopathy is a weakening and enlargement of the heart muscle that makes it harder for it to pump blood.
Alcohol consumption was the most common cause (about 26 percent) in people ages 40 to 59, and obesity was the most common cause (almost 23 percent) in people older than 60.
The findings reinforce coronary artery disease as one of the most common causes of sudden cardiac death, but also identify other causes of sudden death in different age groups.
The study was published Oct. 3 in the October issue of the journal HeartRhythm.
