To restore integrity to government function with the Treasury debt of war satisfied, it is necessary to address paying Congress their legitimate salary, and whatever cuts to their salary or budget may be necessary to offset the debt created by the Bush Tax Cuts. Without Tax Reform in place and IRS Reform, taxpaying voters see taxation and Obamacare not as health care, but remuneration repealed by the House. Essentially, it is Obamatax, without addressing real substantive health reform or creating a federal program for the uninsured, because abortions are not an ethical or adequate funding mechanism for services rendered.

Therefore, there has been much discussion over what is a fair share of taxes and who is paying their fair share. The government provides a service. Typically, a service does not exceed 20% of income. It is very important to not burden the middle class, who has been buried under inflation and a heavy income tax bracket that is 35% in addition to the 7% sales tax paid to the state. Democrats do not seem to understand how paying Congress a legitimate salary irons out the bloating from having to borrow to pay Congress, when the interest is $600-$700 billion.

The Path to Prosperity Budget Plan specifically discusses cuts, closing loopholes, and how to properly fund a budget. The Tea Party discussed their differences on the proposal, and budgetarily how to meet the goals of our proposed budget plans:

ALL OF THESE PEOPLE WILL BE PAYING SOME FORM OF TAXES THAT THEY WEREN’T PAYING BEFORE:

1) About 46.4 percent of U.S. households didn’t pay federal income taxes in 2011. Mitt Romney’s right about that.

2) That number is abnormally high right now in part due to the recession and slow recovery. When people lose their jobs or see their paychecks drop, they tend to pay fewer income taxes as well. (That’s why the budget deficit tends to increase in a bad economy.) Additionally, Congress has passed a slew of tax cuts as part of its stimulus efforts. So that’s skewed the number of nonpayers. When the economy’s at full employment, as it was in 2007, it’s usually only about 40 percent of U.S. households that aren’t paying income taxes:

3) The vast majority of households that don’t pay federal income taxes are either elderly or paying payroll taxes. As you can see below, 60 percent of those who don’t pay income tax are still working and paying taxes for Social Security and Medicare. Their tax liability is just too low to qualify for the income tax. Another 22 percent of non-payers are retirees.
Only about 7.9 percent of households are not paying any federal taxes at all. That’s usually because they’re either unemployed or on disability or students or are very poor.

4) Many low-income workers don’t pay federal income taxes thanks, in part, to a series of tax cuts endorsed by Republicans over the years. The graph below from the Tax Policy Center shows why so many workers who do earn income don’t have to pay the income tax. They’re exempt under various provisions of the tax code.
For instance, most (though not all) elderly households are excluded from paying taxes on their Social Security benefits. And low-income workers with children can qualify for the Earned Income Tax Credit or the Child Tax Credit. As Keith Hennessey explains, the latter was a major GOP initiative during the 1990s and 2000s, and conservatives used to tout them as vital poverty-reduction measures:

5) The number of people who don’t pay federal income taxes tends to jump every time there’s a big tax cut bill, as after the 1986 tax reform or the 2001 Bush tax cuts. There’s a reason why George W. Bush was boasting, in 2004, about moving 5 million taxpayers “off the rolls.” He didn’t think he was creating an army of Obama voters. He thought it was good policy:

6) About 30 percent of workers had a negative income tax in 2011, thanks to the Earned Income Tax Credit (EITC), which gives them a big refund. But these beneficiaries tend to leave the program fairly quickly. Many low-income workers actually receive extra money through the tax code, thanks to the EITC. Again, this is an anti-poverty program long supported by Republicans.
What research has shown, however, is that most EITC recipients only get the credit for two consecutive years or less. Many of them soon move up the income ladder and start paying taxes back into the system. One paper found that, over their lifetime, these EITC recipients pay more in taxes than they receive in benefits:

7) Over their full lifetime, the vast majority of workers end up paying income taxes and federal taxes. As this graph  from the Hamilton project shows, it’s mainly the very young and the very old who aren’t paying income taxes. The vast majority of workers pay income taxes during their prime years, and an even higher percentage of Americans pay into Medicare and Social Security throughout their lives:
8) Federal taxes are just part of the picture. Most Americans also pay state and local taxes, such as sales taxes. These tend to be more regressive and hit lower-income groups harder. Here’s what the system looks like when you add up all taxes:

Libya: Militiaman denies role in Benghazi attack

TRIPOLI, Libya (AP) — A Libyan Islamist militia commander who witnesses claimed led the deadly assault on the U.S. Consulate in Benghazi denies he was involved.
Ahmed Abu Khattala told The Associated Press on Thursday that he has not been questioned by Libyan authorities and is "living normally" in the eastern city.
"All this talk is baseless," he said by telephone. "I am in Benghazi, have a job and live my life normally. I have not been accused by any party with any allegations ... I am not a fugitive or in hiding," he added.
Abu Khattala was named by Libyan witnesses as the leader of the Sept. 11 attack that killed U.S. Ambassador Chris Stevens and three other Americans.

KHAR, Pakistan (AP) — One of the two Taliban militants suspected of attacking a teenage girl activist was detained by the Pakistani military in 2009 but subsequently released, intelligence officials said Thursday.
Malala Yousufzai, 14, was shot and critically wounded on Oct. 9 as she headed home from school in the northwest Swat Valley. The Taliban said they targeted Malala, a fierce advocate for girls' education, because she promoted "Western thinking" and was critical of the militant group.
The military detained Attaullah and several of his associates during the army's 2009 offensive in Swat because of suspected ties with the Pakistani Taliban, which had established effective control over the valley at the time, said two intelligence officials. They spoke on condition of anonymity because they were not authorized to talk to the media.
The military successfully pushed most of the militants out of Swat, but Attaullah was released because of a lack of evidence linking him to specific attacks, said the officials. It's unclear how long he was held.
Authorities have detained several of Attaullah's family members in Swat, but he remains at large, said the officials.
It's possible he could have fled to neighboring Afghanistan. The Taliban have said the attack on Malala was planned by the head of the Swat Taliban, Maulana Fazlullah, and his deputies, who escaped to Afghanistan following the military offensive in 2009.
The shooting of Malala outraged people around the world and stepped up pressure on the Pakistani government to intensify its fight against the Taliban and their allies. But Pakistani leaders are divided on whether the government should respond by targeting the Taliban's last major sanctuary in the country along the Afghan border. Pushing into the North Waziristan tribal area could trigger a backlash of attacks elsewhere in Pakistan.
Malala was airlifted to England earlier this week for specialized treatment and to protect her from follow-on attacks by the Taliban, who have threatened to target her again until she is killed.
A Pakistani official said Wednesday that Malala was improving and has been moving her limbs. The official, who said he was briefed by Malala's doctors in England, spoke on condition of anonymity because he wasn't cleared to talk on the record about the case.

JERUSALEM – While echoes of the “Fast and Furious” scandal still resound in the White House, another administration decision at the heart of Obama’s Mideast policy may prove even more explosive.
Almost entirely missing from the debate surrounding the anti-U.S. attacks in Libya is the administration’s policy of arming jihadists to overthrow Mideast governments. But in the case of Libya, the arming of jihadists may have directly resulted in the Sept. 11, 2012, attacks against the U.S. consulate in Benghazi and the subsequent murder of Ambassador J. Christopher Stevens, Foreign Service Information Management Officer Sean Smith, private security employees and former U.S. Navy SEALs Glen Doherty and Tyrone Woods.

After changing its story multiple times, the White House finally conceded the deadly assault on the U.S. consulate was a planned attack linked to al-Qaida, as per information released by national intelligence agencies.
The admission prompted Rep. Peter King, R-N.Y., to call for the resignation of U.S. Ambassador to the United Nations Susan Rice for pushing the narrative that the attacks were part of a spontaneous uprising.
King may instead want to focus his investigative energies on the larger story: How the Obama administration armed Libyan rebels who were known to include al-Qaida and other anti-Western jihadists, and how the White House is currently continuing that same policy in Syria.
During the revolution against Muammar Gadhafi’s regime, the U.S. admitted to directly arming the rebel groups.
At the time, rebel leader Abdel-Hakim al-Hasidi boasted in an interview that a significant number of the Libyan rebels were al-Qaida gunmen, many of whom had fought U.S. troops in Iraq and Afghanistan.
Hasidi insisted his fighters “are patriots and good Muslims, not terrorists,” but he added that the “members of al-Qaida are also good Muslims and are fighting against the invader.”
Even Adm. James Stavridis, NATO supreme commander for Europe, admitted during the Libyan revolution that Libya’s rebel force may include al-Qaida: “We have seen flickers in the intelligence of potential al-Qaida, Hezbollah.”
At the time, former CIA officer Bruce Riedel went even further, telling the Hindustan Times: “There is no question that al-Qaida’s Libyan franchise, Libyan Islamic Fighting Group, is a part of the opposition. It has always been Gadhafi’s biggest enemy and its stronghold is Benghazi. What is unclear is how much of the opposition is al-Qaida/Libyan Islamic Fighting Group – 2 percent or 80 percent.”
The arming of the Libyan rebels may have aided in the attacks on our consulate in Libya. One witness to those attacks said some of the gunmen attacking the U.S. installation had identified themselves as members of Ansar al-Shariah, which represents al-Qaida in Yemen and Libya.
The al-Qaida offshoot released a statement denying its members were behind the deadly attack, but a man identified as a leader of the Ansar brigade told Al Jazeera the group indeed took part in the Benghazi attack.
Ambassador Stevens was directly involved in arming the rebels, reported Egyptian security officials speaking to WND. Those officials claimed Stevens played a central role in recruiting jihadists to fight Bashar al-Assad’s regime in Syria.
The officials further claimed Stevens served as a key contact with the Saudis to coordinate the recruitment by Saudi Arabia of Islamic fighters from North Africa and Libya. The jihadists were sent to Syria via Turkey to attack Assad’s forces, said the security officials.
The Egyptian security officials said Stevens also worked with the Saudis to send names of potential jihadi recruits to U.S. security organizations for review. Names found to be directly involved in previous attacks against the U.S., including in Iraq and Afghanistan, were ultimately not recruited by the Saudis to fight in Syria, said the officials.
Regardless of Stevens’ alleged role, the Obama administration now continues to support the Syrian rebels, including the Free Syrian Army, despite widespread reports that al-Qaida is prominent among their ranks.
In addition to a reported $450 million in emergency cash for the Muslim Brotherhood-led Egyptian government, Secretary of State Hillary Clinton on Friday announced $45 million in additional aid for Syrian the opposition after nearly $100 million was provided to the Syrian rebels this year.
The problem? Last month, WND quoted a senior Syrian source claiming at lease 500 hardcore mujahedeen from Afghanistan, many of whom were spearheading efforts to fight the U.S. there, were killed in clashes with Syrian forces last month.
Also last month, WND reported Jihadiya Salafia in the Gaza Strip, a group that represents al-Qaida in the coastal territory, had declared three days of mourning for its own jihadists who died in Syria in recent weeks.
WND reported in May there was growing collaboration between the Syrian opposition and al-Qaida, as well as evidence the opposition is sending weapons to jihadists in Iraq, according to an Egyptian security official.
The military official said that Egypt has reports of collaboration between the Syrian opposition and three al-Qaida arms, including one the operates in Libya:
Jund al-Sham, which is made up of al-Qaida militants who are Syrian, Palestinian and Lebanese;
Jund al-Islam, which in recent years merged with Ansar al-Islam, an extremist group of Sunni Iraqis operating under the al-Qaida banner and operating in Yemen and Libya;
Jund Ansar al-Allah, an al-Qaida group based in Gaza linked to Palestinian camps in Lebanon and Syria.
U.S. officials have stated the White House is providing nonlethal aid to the Syrian rebels, while widespread reports have claimed the U.S. has been working with Arab countries to ensure the opposition in Syria is well armed.

ISSA THREATENS TO SUBPOENA SEBELIUS OVER MEDICARE SLUSH FUND

President Obama had a big political problem: Obamacare destroys the popular Medicare Advantage program, which offers private insurance plans to supplement Medicare.  Something like a quarter of Medicare beneficiaries use this program.  (It’s funny how free-market competition is both popular and effective when it’s actually tried, isn’t it?)
Obamacare sucks over $200 billion out of Medicare Advantage, something that would have been very noticeable through price increases and benefit reductions during open enrollment… which began in October, right before the election.
If you’re Barack Obama, you solve a problem like that by throwing huge amounts of other peoples’ money at it.  So it was that a little “demonstration project” to reward the most effective Medicare Advantage plans was suddenly inflated into a titanic $8.3 billion slush fund – bigger than the 85 previous demonstration projects combined – in order to delay the pain of Medicare Advantage cuts until after the election.  The standards for receiving payouts from this “incentive” program were lowered so much that even mediocre plans could receive a “reward.”  It wouldn’t do to have seniors opening envelopes that say their premiums have skyrocketed or some of their favorite benefits have been dropped, right before the election!
The House Oversight Committee began investigating this jumbo Slurpee of slush in May, and ran into a Health and Human Services stonewall so obvious that it’s comical.  A request for documents on May 23 was ignored by HHS.  It was repeated on August 1, and ignored again.  House Oversight fired off emails to a couple of HHS staffers, and didn’t get a response for weeks… at which point the HHS Deputy Director for Oversight and Investigation said, “I’m checking on the status and will get back to you,” but never got back to anybody.
By September 27, it was dog-ate-my-homework time.  HHS staff said they’d “been working hard to pull documents together that are responses to your boss’s request and we plan to get you what we can ASAP.”  A week later, House Oversight asked how it was going.  “Actually, we’re aiming for tomorrow,” chirped the HHS staff.  “The copying machines are working overtime.”  Tomorrow came, with no documents produced.  The HHS was so very, very sorry for the delay.  “Just checked,” they sobbed.  “Unfortunately, it looks like tomorrow they’ll get it to you.”
That was on October 4.  By October 9, House Oversight was still looking at an empty in-box, and blood pressures were rising.  “The day got away from me,” an HHS staffer apologized.  “It looks like we’ve made some progress but I should know more in a day or two.”  Maybe House Oversight should have offered to roll a cart full of copy-machine toner over to Health and Human Services.
“We’re still working on this and I do think the end of the week is doable,” said HHS the next day.  “Could we touch base tomorrow?”  No bases were touched, but on October 12, HHS said they had “fingers and toes crossed” for delivery the next day.  All of those appendages were uncrossed by October 15, when HHS simply stopped pretending it could meet any sort of deadline.  I would imagine sometime after November 6 might be “doable.”
House Oversight chairman Darrell Issa (R-CA) ran out of patience with these antics, and wrote a letter to HHS Secretary Kathleen Sebelius, in which he said “your staff has run out of excuses and the long delay in providing these documents is inexcusable.”  He was blunt about precisely what his Committee is investigating:
Your reluctance to provide the Committee with these documents suggests that the documents and communications do not justify the Administration’s assertion that there is no limit to what the Secretary of HHS can spend on demonstrations, the Administration’s decision to exempt this Demonstration from long-established budget neutrality rules, or the Administration’s decision to waive the requirement for an evaluation by a statistical expert for this Demonstration, among other unsupported assertions.
Since [Government Accountability Office] experts testified the Demonstration’s design makes it impossible for the project to “demonstrate anything,” we are concerned that the only plausible explanation for the Demonstration is that you decided to utilize a loophole in the Social Security Act to temporarily cover up ObamaCare’s large cuts to the 13 million seniors enrolled in Medicare Advantage until after this year’s election.
Issa set a deadline of 5:00 PM Thursday for the production of the documents, or else it’s subpoena time.  I doubt that’s going to get him anywhere with the lawless Obama Administration, which didn’t exactly fall all over itself to comply with those Fast and Furious subpoenas.  And Kathleen Sebelius flaunts laws that inconvenience her, such as the Hatch Act, with impunity.  She only needs to run out a few more weeks until the election.  Then she’ll either be protected by the general “let’s stop obsessing over the past” spirit of transition to a new Administration after the holiday break, or… well, let’s just say Barack Obama’s not going to develop a sudden new respect for the law, once he knows he’ll never have to answer to voters again.

From Robotic Squirrels to Martian Pizza, Report Cites Billions In Government Waste

*Sen. Tom Coburn (R-OK) has released his annual report on wasteful spending, titled appropriately, “Wastebook 2012″. The report highlights, according to Coburn’s office, “100 of the year’s countless unnecessary, duplicative and low-priority projects spread throughout the federal government.”
And this year, there was plenty to choose from. Despite calls from both sides of the aisle to reduce spending, Congress was happy to cough up dollars and tax breaks for pet projects – when they bothered to show up at all, that is. In all, wasteful spending and unnecessary tax breaks totaled nearly $19 billion.

For starters, Sen. Coburn attacked tax loopholes afforded to the National Football League (NFL), National Hockey League (NHL) and Professional Golfers’ Association (PGA). Those are professional sports leagues that generate billions of dollars annually in profits but receive tax exempt status, like the National Collegiate Athletic Association (NCAA). Those organizations are treated as non-profit under the Tax Code. Yes, read it again. Non-profit. The NFL – which generated $9 billion in revenue last season, holds nearly $1 billion in assets and will pay its commissioner, Roger Goodell, nearly $20 million in 2019 – enjoys nearly the same tax status as the American Red Cross (there are some distinctions under section 501(c) for purposes of donations and deductibility). It’s worth noting that Major League Baseball (MLB) gave up its tax-exempt status in 2007 (hooray for baseball!).
Also on the list? “Junk food, luxury drinks, soap operas, and billions of dollars in improper food stamp payments” which Sen. Coburn says totaled $4.5 billion in 2012. Coburn’s report indicated that food stamp payments were used not only at grocery stores but at Burger King, Kentucky Fried Chicken, Taco Bell, Pizza Hut, Dominoes Pizza and Starbucks. While the discussion on the federal food stamp program can be complicated, I think we can agree that it’s not healthy that “[f]ifty-eight percent of all refreshment beverages purchased by SNAP participants were for sugar-sweetened beverages.”
Other targets in Sen. Coburn’s report include Moroccan pottery classes, a $325,000 National Science Foundation (NSF) grant to construct a robotic squirrel named “RoboSquirrel” to determine what happens when a snake is confronted by a robot squirrel and “Prom Week”, a video game that allows taxpayers to relive prom night (I don’t know about you but with apologies to my date, mine wasn’t so great that I would want to relive it virtually).
Taxpayers also paid for the promotion of caviar consumption (ooh la la!) as well as specialty shampoo and other beauty products for cats and dogs. And while Sen. Coburn singled out the 2012 Alabama Watermelon Queen tour paid for in part by the U.S. Department of Agriculture “to promote the consumption of Alabama’s watermelon through appearances of the Alabama Watermelon Queen at various events and locations”, we shouldn’t lose sight of the fact that taxpayers also pay to promote Christmas tree sales as well as cotton, mangoes and many other products.
And while it shouldn’t cost a lot of money to make -literally – money, it actually does. The cost to produce a penny in 2012 is more than two times its actual value (nickels cost 11 cents to make). The total cost of producing over 5 billion pennies this year will run at least $120 million which means that after selling the pennies at face value to the Federal Reserve, the Treasury Department will lose over an estimated $70 million – that’s not including what we lose on nickels. So taxpayers are paying more to make, well, less money.
My favorite wasteful expenditure? National Aeronautics and Space Administration’s (NASA) Advanced Food Technology Project, which spent nearly $1 million to develop a recipe for pizza and about 100 other foods that could be served some day on Mars. Martian pizza? Although, to be fair, I’d totally try that – it has to be at least as good as space ice cream.
The report goes on to detail billions more in wasteful spending and tax cuts. So who is to blame? Sen. Coburn put much of the blame for the wasteful spending on Congress, which he described as “deeply ineffectual.” He cited a study that “[a] stunning 83 percent disapprove of ‘the way Congress is doing its job’ as he laid out their failures to act. Included in that litany? He notes that the Senate has cast fewer votes in 2012 thus far than any year in decades and more than 20% of Senator have not had a single amendment considered on the Senate floor in 2012. He cites the wastefulness attributable to Congress as $132 million – that must include the more than $13 million Congress was paid while on its latest seven week recess. Fiddling much while Rome burns?Remember that in November, folks.

(Reuters) - The international mediator on Syria said on Wednesday its civil war risks spilling across borders to engulf the Middle East and appealed for a temporary truce he said could mark a small step towards defusing 19 months of conflict.

Lakhdar Brahimi, the U.N.-Arab League envoy, has proposed that both President Bashar al-Assad's forces and rebel fighters seeking his overthrow hold fire during the Islamic feast holiday of Eid al-Adha that starts next week.

Syrian authorities, who blame rebels for the failure of an April ceasefire plan, guardedly welcomed Brahimi's proposal but said any initiative must be respected by both sides.

Thirty-thousand people have been killed in the uprising, which began with peaceful demonstrations and now pits mainly Sunni Muslim rebels against an Alawite president. There are fears of broader Middle East sectarian conflict between Sunni powers sympathetic to the
rebels and Shi'ites who back Assad.

"This crisis cannot remain within Syrian borders indefinitely. Either it will be addressed or it will increase ... and be all-consuming," Brahimi told reporters in Beirut after talks with Lebanese leaders.

The British-based Syrian Observatory for Human Rights said at least 90 people had been killed in Syria by late afternoon on Wednesday, after 150 people died the day before.

The death toll has topped 1,000 a week for at least two months as divided world powers have condemned the bloodshed in what has become a largely stalemated conflict, but failed to agree on a political solution.

On Sunday, Brahimi appealed to leaders in Iran - Assad's strongest regional ally - to support a proposal for a ceasefire to mark Eid al-Adha, expected to begin at dusk on October 25.

Syrian officials have questioned whether the disparate rebels, who agreed on a joint leadership on Tuesday [ID:nL5E8LGRQ5] to encourage supporters to provide them more powerful weapons, could commit to or honour any ceasefire deal.

But Brahimi said opposition figures had told him any ceasefire by Assad's forces would be reciprocated immediately.

"We heard from everyone we met in the opposition, and everyone (else) we met that, if the government stops using violence, 'We will respond to this directly'," he said.

"We hope this will be a very small step that would save the Syrian people ... because they are burying hundreds of people every day."

HELICOPTER DOWNED

Anti-Assad activists posted videos on Wednesday of what they said was a Syrian military helicopter spiralling to the ground and exploding in flames.

Rami Abdelrahman, head of the Syrian Observatory for Human Rights, said that the helicopter had been downed near Maarat al-Numan. "Some rebels say they used anti-aircraft missiles," he told Reuters by telephone from Britain.

Amateur footage of rebels using shoulder-mounted surface-to-air missiles have emerged in the past few days, and France's Foreign Minister Laurent Fabius said that heavy weapons acquired by the insurgents have forced Assad's air force to bomb rebel-held areas from high altitude.

"In a certain number of these zones, Bashar al-Assad is bombarding them with MiG fighter jets, and what is particularly horrible is that he is bombarding them with TNT," Fabius said.

"But at the same time there are now weapons that are forcing the planes to fly extremely high, and so the strikes are less accurate," he said before meeting civilian members of rebel councils that run areas outside government control.

France began channelling money and humanitarian aid to rebel-held parts of Syria in August to support self-rule and try to create an alternative to the Damascus government.

However, the French plan falls well short of the foreign-protected safe havens the opposition says it needs and offers little hope of relief to civilians fleeing the chaos.

Russia, which sold Syria arms worth $1 billion last year, and China have vetoed three resolutions favoured by Western powers condemning Syrian authorities and opening the way to U.N. sanctions on Damascus.

Fabius said Moscow's stance would only cement chaos in Syria, adding that he had told Russian Foreign Minister Sergei Lavrov that: "If you continue to oppose a change of regime, then the extremists risk taking control."

Russia denies trying to prop up Assad, who allows Russia to maintain a naval supply facility in the port of Tartus that is its only military base outside the former Soviet Union.

But Moscow says Syria's crisis must be resolved without foreign interference, particularly military intervention.

Syrian Foreign Ministry spokesman Jihad Makdissi said Damascus hoped Brahimi's talks in the region, including with countries which back the rebels, could herald "something which leads to the success of a constructive initiative".

Makdissi said Syria had previously committed to Arab and U.N. initiatives but that they had been thwarted by "armed groups and the countries that influence them".

Secretary of State Hillary Clinton fell on her sword on Monday and took "responsibility" for the lack of security in Libya leading up the terrorist attacks. In response, Republican Senators John McCain (AZ), Lindsay Graham (SC), and Kelly Ayotte (NH) said while Clinton made a "laudable gesture" with her remarks, the buck still stopped with President Barack Obama at the White House.The Senators, in a statement, said if Obama had not been aware of the rising threat level in the Middle East, especially in Libya, then they have "lost confidence" in the administration's national security team. But if Obama had known about the threats against U.S. interests in Libya, the Senators said "he bears full responsibility for any failures that occurred." “If the President was truly not aware of this rising threat level in Benghazi, then we have lost confidence in his national security team, whose responsibility it is to keep the President informed," the Senators said. "But if the President was aware of these earlier attacks in Benghazi prior to the events of September 11, 2012, then he bears full responsibility for any security failures that occurred. The security of Americans serving our nation everywhere in the world is ultimately the job of the Commander-in-Chief. The buck stops there."The Senators also said the American people deserve to know why the Obama administration insisted that the "attack in Benghazi was the result of a spontaneous demonstration triggered by a hateful video, long after it had become clear that the real cause was a terrorist attack.""The President also bears responsibility for this portrayal of the attack, and we continue to believe that the American people deserve to know why the Administration acted as it did," they wrote. The Senators also noted that Americans “must remember that the events of September 11 were preceded by an escalating pattern of attacks this year in Benghazi, including a bomb that was thrown into our Consulate in April, another explosive device that was detonated outside of our Consulate in June, and an assassination attempt on the British Ambassador.”Earlier, during a visit to Peru, CNN reported Clinton said she took "responsibility" and tried to absolve Obama and Vice President of blame for the lax security in Libya because Clinton was "in charge of the State Department's 60,000-plus people all over the world, 275 posts.""The president and the vice president wouldn't be knowledgeable about specific decisions that are made by security professionals," Clinton said. "They're the ones who weigh all of the threats and the risks and the needs and make a considered decision."Clinton also said that "in the fog of war, there's always going to be confusion" and "I think it is absolutely fair to say that everyone had the same intelligence. Everyone who spoke tried to give the information that they had. As time has gone on, that information has changed. We've gotten more detail, but that's not surprising. That always happens." Senators McCain, Graham, and Ayotte said Clinton made "a laudable gesture, especially when the White House is trying to avoid any responsibility whatsoever."

During 2011, cyber security incidents included theft of intellectual property and government data, hacktivism, malware targeting mobile devices and a resurgence of the Zeus Trojan, which targets financial information. Protecting against these attacks was a key challenge for organizations of all sizes in both the public and private sectors.
What is in store for 2012? Below is a brief round up of the cyber security threat landscape highlighting some of the challenges we can expect during the next 12 months.
Mobile Devices and Apps
The use of mobile devices will continue to grow in 2012, consequently, so too will the volume of attacks targeted to these devices. Every new smart phone, tablet or other mobile device provides another window for a potential cyber attack. Closely tied to the trend of more smart phones and tablets being deployed in the enterprise will be the influx of new apps for those devices. Location-based mobile apps and games all pose potential threats. The risks include access to information such as physical location or contacts lists, as well as the ability for the apps to download malware, such as keyloggers or programs that eavesdrop on phone calls and text messages. Hackers are quickly learning how to harvest legitimate applications and repackage them with malicious code before selling/offering them on various channels to the unsuspecting user.
Hactivism
Attacks carried out as cyber protests for a politically or socially motivated purpose are expected to increase, especially in light of the activist movements continuing to take place across the country and around the globe. Common strategies used by hactivist groups include denial of service attacks and compromise of user credentials to gain access to data, along with posting of emails, credentials, credit card information and other sensitive exfiltrated information.
Search Engine Optimization (SEO) Poisoning
Cyber criminals will continue to take advantage of the 24-hour news cycle to target visitors searching on the most popular keywords or sites and infect users via sites designed to look like legitimate news services, Twitter feeds, Facebook posts/emails, LinkedIn updates, YouTube video comments, and forum conversations. We expect cyber criminals to take advantages of notable news events such as the London Olympics, U.S. presidential elections, and Mayan calendar predictions.
Social Engineering
Social engineering tactics -- including the use of rogue anti-virus to entice users into clicking on malicious links -- will continue. Experts also anticipate that in 2012 we will also see a growth in fake registry cleanup, fake speed improvement software, and fake back-up software mimicking popular personal cloud services.
Advanced Persistent Threat
Advanced Persistent Threat (APT) refers to a long-term pattern of targeted hacking attacks using subversive and stealthy means to gain continual, persistent exfiltration of intellectual capital. The entry point for espionage activities is often the unsuspecting end-user or weak perimeter security. APT is likely to remain high in 2012. Whether focused on exploiting vulnerable networks for use as a storage location or relay point, or to gain insider information, cyber espionage will remain a consistent threat to networks.
Spear Phishing Attacks
Spear phishing is a deceptive communication (e-mail, text or tweet) targeting a specific individual, seeking to obtain unauthorized access to confidential data. Spear phishing attempts are not typically initiated by "random hackers" but are more likely to be conducted by perpetrators seeking financial gain, trade secrets or sensitive information. Spear phishing is often the nexus to cyber espionage and will continue to grow.
What Can You Do?
By using sound cyber security practices, users and organizations can strengthen readiness and response to help defend against the myriad of challenges and mitigate potential impacts of incidents:
  • Make sure that you have encryption and password features enabled on your smart phones and other mobile devices.
  • Use strong passwords, ones that combine upper and lower case letters, numbers, and special characters, and do not share them with anyone. Use a separate password for every account. In particular, do not use the same password for your work account on any other system.
  • Properly configure and patch operating systems, browsers, and other software programs.
  • Use and regularly update firewalls, anti-virus, and anti-spyware programs.
  • Do not use your work email address as a "User Name" on non-work related sites or systems.
  • Be cautious about all communications; think before you click. Use common sense when communicating with users you DO and DO NOT know. Do not open email or related attachments from un-trusted sources.
  • Don't reveal too much information about yourself on social media websites. Depending on the information you reveal, you could become the target of identity or property theft.
  • Verify Location Services settings on mobile devices.
  • Allow access to systems and data only by those who need it and protect those access credentials.
  • Follow your organization's cyber security policies and report violations and issues immediately.

JERUSALEM (Reuters) - The United States and Israel will hold a major missile defense exercise in Israel this month, sending a message of close cooperation as both countries weigh their options over Iran's nuclear program.
The three-week exercise, the largest the allies have ever held, will simulate a variety of long and short-range missile attacks that Israel could face during a regional conflict, said the commanders in charge.
Asked whether it sent a message to Iran, which has warned of an all-out war should Israel try to strike its nuclear facilities, Israeli Brigadier General Nitzan Nuriel said: "Anybody can get any type of message from this exercise."
"The fact that we are practicing together and working together is a strong message by itself," Nuriel said during a conference call with reporters.
Offering a more guarded response, his U.S. counterpart, Lieutenant General Craig Franklin said the exercise, "is not there to send a message", adding that it has been in planning for more than two years.
"This exercise will improve the cooperative missile defense of Israel and will promote regional stability and help ensure our military edge," he said.
More than 3,500 U.S. personnel will take part in the drill, about 1,000 of them in Israel, Franklin said, putting a total price tag on the exercise at $60 million.
The weapons will include U.S. Patriot missile batteries and an AEGIS ballistic missile defense ship, along with the multi-tiered missile defense system that Israel has been developing. All but one of the launches will be simulated.
Martin Dempsey, the U.S. Chairman of the Joint Chiefs of Staff, will observe part of the drill, said Pentagon spokeswoman Lieutenant Commander Wendy Snyder.
Dempsey confounded some Israeli leaders in August when he told reporters the United States did not want to be "complicit" in an Israeli attack on Iran.
He also warned that go-it-alone military action risked unraveling an international coalition that has applied progressively stiff sanctions on Iran, which insists that its ambitious nuclear project is purely peaceful.
An Iranian military commander said last month the Islamic Republic would make no distinction between U.S. and Israeli interests and will retaliate against both countries if attacked.
Israeli Prime Minister Benjamin Netanyahu has been pushing the United States to set Iran an ultimatum or risk seeing Israel launch unilateral strikes. Washington says it will not allow Tehran to obtain nuclear weapons, but has not set out its own red lines.

Monsanto tries to criminalize saving seeds, drags farmer into court

(NaturalNews) As if its costly genetic tampering with the whole natural world weren't brazen enough, Monsanto continues to bully and intimidate farmers across the United States, hoping this time to push its agenda through the highest court in the justice system.

The Supreme Court agreed last week to hear an appeal regarding Monsanto's case against Knox County, Indiana soybean farmer Vernon Hugh Bowman. Monsanto has pursued a lawsuit against the 74-year-old claiming Bowman made unauthorized use of its patent-protected Roundup Ready seeds. Bowman reportedly purchased additional, cheaper seed from a local grain elevator and used it to plant a late-season crop. He repeated this activity over a period of eight years beginning in 1999, continually saving and planting the new seeds generated by the commodity elevator crop.

Though Bowman was saving seeds from only the elevator crop, nature was doing what nature does best. With the Monsanto variety in the 90-percent majority over the other crop on Bowman's 299-acre farm, it was only a matter of time before contamination occurred. When it did, and Monsanto learned of Bowman's seed harvesting activities, they sent their well-funded attorneys after him for patent infringement.

Bowman lost his case in the lower courts in 2009 and was ordered to pay Monsanto more than $84,000 in damages and costs. Then came a subsequent decision last year from the U.S. Court of Appeals for the Federal Circuit, which ruled that "once a grower, like Bowman, plants the commodity seeds containing Monsanto's Roundup Ready technology and the next generation of seed develops, the grower has created a newly infringing article."

The ruling fully supported the policies of Monsanto, the chemical company that also genetically engineers seeds to be either pesticide-producing (to kill pests, by breaking open their stomachs) or pesticide-resistant (to encourage the spraying of crops with more chemicals). The company prohibitsfarmers who purchase and grow their genetically modified seeds from saving or reusing the seeds for future planting, thereby forcing those farmers to purchase new seeds each year. It's a business model that so far has allowed the chemical giant to increase sales of both its Roundup pesticide and its GMseeds, while simultaneously putting small, struggling farmers out of business.

But Bowman's team would not surrender. Having come this far in a longstanding battle against the biotech giant, he and opponents of genetic engineering hope the Supreme Court will overturn the appellate decision when it hears the case this winter.

Obama Administration pressures court to perpetuate Monsanto agenda

A decision by the Supreme Court on this case could send huge ripples throughout the biotech industry, seriously impacting patents involving DNA molecules, nanotechnologies and other self-replicating sciences. That was the warning from the Obama Administration, in a filing that urged the court not to take the case. It stated that "the incentive to invest in innovation and research might well be diminished" by a ruling against Monsanto that reduced the normal 20-year patent protection term to just one year, or even to a single growing season. The administration advised the justices that it would not be appropriate for them to address the implications of patent protectionism versus traditional farming techniques, stating outright that "Congress is better equipped than is this court" for such a task.

Monsanto agreed with that reasoning, insisting to the court that a decision in favor of the farmer would irrevocably harm its business model and that its "ability to protect its patented technology would effectively be lost as soon as the first generation of the product was introduced into the market."

But if previous rulings by the Supreme Court are any indication, Monsanto may not have much reason to worry. Lest we forget, it was a 1980 Supreme Court decision (Diamond v. Chakrabarty) that paved the way for the U.S. Patent and Trademark Office to begin granting patents on specific life forms in 1985. Since that time, Monsanto has aggressively sought and acquired more bio-engineering and seed patents than other biotech company. So it makes sense that a decision against them now would upset their idea of balance.

Farmers and freedom-lovers stand up to biotech bully

The legal cat-and-mouse game Monsanto has been playing for years now, targeting roughly 500 farming plantations for investigation and actually filing about 145 lawsuits annually, might finally be turning to bite them in their backside.
As anger builds over Monsanto's unethical business practices, farmers and community members all over the country are beginning to organize against the biotech giant. In a case that's currently pending review by the U.S. Court of Appeals for the Federal Circuit in Manhattan, New York, more than 300,000 individuals and 4,500 farms have brought the legal fight to Monsanto's door step (Organic Seed Growers and Trade Association et al. vs. Monsanto) seeking a ruling forbidding Monsanto to sue them for patent infringement if their crops become contaminated by Monsanto's GM seed.
In California, the battleground is the November ballot box. Debates are heating up over Proposition 37, which asks voters to decide whether to require labeling of genetically engineered foods. Moore, 49, donned a black-and-nude print cocktail dress for the occasion, her long hair in healthy waves.
The actress looked serene amid reports that she is still very much "frustrated" over ex Ashton Kutcher's new romance with much-younger Mila Kunis, 29.
"She was always insecure over the course of her marriage," a friend told Us Weekly of Moore's reaction to the blooming relationship. "So yeah, it's hurtful that he's with someone he knew the whole time he was with her."

Ashton Kutcher’s public relationship with girlfriend Mila Kunis has left Demi Moore in distress, says source close to Moore.

Other sources tell People magazine that the "LOL" actress is "frustrated and jealous" that Kutcher seems to have moved on with his life.
Earlier this week, Kutcher was named this year's highest paid actor on TV by Forbes magazine, reeling in $24 million a year and beating out former chart-topper Charlie Sheen.
And just last month, Kutcher, 34, and Kunis paraded their love throughout New York City, even donning matching Chicago Bears shirts and jeans as they strolled through Central Park.

A judge denied a defense request to suppress text messages as evidence in the case of a former teacher accused of having sex with a student.

COVINGTON, Ky. —
A former Cincinnati Bengals cheerleader who pleaded guilty to having sex with her 17-year-old former student while she was a teacher at a northern Kentucky high school has had the emergency protection order against her ex-husband extended.

Sarah Jones, 27, said she is living every day in fear of her former husband, Nate Wilburn.
Jones' attorney, Eric Deters, said Wilburn threatened to kill Jones if she publicly admitted that she had sex with the student.
"Nate Wilburn has threatened to kill Sarah Jones. She has audio proof of that," Deters said.
News 5's Alison Montoya said that in court Wednesday, Wilburn admitted to harassing Jones, saying there was going to be a murder-suicide and that he wanted to break her neck.
Wilburn said he had harassed Jones as recently as Oct. 7.
The judge set the restraining order to three years and ordered Wilburn to stay 500 feet from Jones at home and at work. The restraining order can be renewed if needed, the judge said.
"It is so bad that to this day Sarah Jones believes she will die at the hands at Nate Wilburn. She gets to the office -- in my office early morning -- we make sure that the doors are locked. We even make sure she has access -- and I'm not making this up -- to a gun because we don't know what he's going to do," Deters said.
In a tearful admission in Kenton County Circuit Court on Oct. 8., Jones pleaded guilty to sexual misconduct and custodial interference in place of more serious charges as part of a plea agreement with prosecutors.
"I began a romantic relationship while he was a student and I was in a position of authority," Jones said, her voice cracking as her family members wiped their own tears.

AUSTIN, Texas -- Lance Armstrong stepped down as chairman of his Livestrong cancer-fighting charity and Nike severed ties with him as fallout from the doping scandal swirling around the famed cyclist escalated Wednesday.
Armstrong announced his move at the charity in an early-morning statement. Within minutes, Nike said that it would end its relationship with him "due to the seemingly insurmountable evidence that Lance Armstrong participated in doping and misled Nike for more than a decade."
Nike said it will continue to support Livestrong.
The U.S. Anti-Doping Agency released a massive report last week detailing allegations of widespread doping by Armstrong and his teams when he won the Tour de France seven consecutive times from 1999 to 2005.

The document's purpose was to show why USADA has banned him from cycling for life and ordered 14 years of his career results erased – including those Tour titles. It contains sworn statements from 26 witnesses, including 11 former teammates.
Armstrong, who was not paid a salary as chairman of the Lance Armstrong Foundation, will remain on its 15-member board. His duties leading the board will be turned over to vice chairman Jeff Garvey, who was founding chairman in 1997.
"This organization, its mission and its supporters are incredibly dear to my heart," Armstrong said in a statement. "Today therefore, to spare the foundation any negative effects as a result of controversy surrounding my cycling career, I will conclude my chairmanship."
Foundation spokeswoman Katherine McLane said the decision turns over the foundation's big-picture strategic planning to Garvey. He will also assume some of the public appearances and meetings that Armstrong used to handle.
Armstrong strongly denies doping, but did not fight USADA accusations through arbitration, saying he thinks the process is unfair. Once Armstrong gave up the fight in August and the report came out, crisis management experts predicted the future of the foundation, known mainly by its Livestrong brand name, would be threatened. They said Armstrong should consider stepping down to keep the charity from getting dragged into a debate over doping.
Armstrong's inspiring story of not only recovering from testicular cancer that had spread to his lungs and brain but then winning the world's best-known bike race helped his foundation grow from a small operation in Texas into one of the most popular charities in the country.
Armstrong drew legions of fans – and donations – and insisted he was drug free at a time when doping was rampant in professional cycling. In 2004, the foundation introduced the yellow "Livestrong" bracelets, selling more than 80 million and creating a global symbol for cancer awareness and survivorship.
"As my cancer treatment was drawing to an end, I created a foundation to serve people affected by cancer. It has been a great privilege to help grow it from a dream into an organization that today has served 2.5 million people and helped spur a cultural shift in how the world views cancer survivors," Armstrong said.
As chairman, Armstrong did not run the foundation's day-to-day operations, which are handled by Livestrong president and chief executive Doug Ulman.
Ulman had said last week that Armstrong's leadership role would not change. Armstrong's statement said he will remain a visible advocate for cancer issues, and he is expected to speak at Friday night's 15th anniversary gala for Livestrong in Austin.
"My family and I have devoted our lives to the work of the foundation and that will not change. We plan to continue our service to the foundation and the cancer community.
We will remain active advocates for cancer survivors and engaged supporters of the fight against cancer," Armstrong said.
CharityWatch, which analyzes the work of approximately 600 charities, lists the foundation among its top-rated organizations. That status normally goes to groups which "generally spend 75 percent or more of their budgets on programs, spend $25 or less to raise $100 in public support, do not hold excessive assets in reserve" and disclose of basic financial information and documents.
Livestrong says it had functional expenses totaling nearly $35.8 million last year and 82 percent of every dollar raised went directly to programs, a total of more than $29.3 million.
The foundation reported a spike in contributions in late August in the days immediately after Armstrong announced he would no longer fight doping charges and officials moved to erase his Tour victories.
Daniel Borochoff, founder and president of Chicago-based CharityWatch, said last week it may take some time for donors to digest the allegations against Armstrong.
"Individuals that admire and support an individual who is later found out to be severely tarnished, don't want to admit it, don't want to admit that they've been duped," Borochoff said. "People, though, do need to trust a charity.

Boy Scouts have released ‘perversion files’

Confidential files that document decades of sexual abuse kept by the Boy Scouts of America are expected to be released Thursday.
(RNN) – The confidential "perversion files" kept by the Boy Scouts of America were released Thursday for public inspection by a Portland attorney. The files have been uploaded to the Oregon law firms website.

Database complied from previous court cases

The Los Angeles Times has compiled a database on thousands of men and women removed from the Boy Scouts of America using 1,900 files which were evidence in a 1992 California lawsuit.
The files range from 1970 to 1991, and about 1,200 of the 1,900 case files overlap in time with the files ordered to be released Thursday by the Oregon Supreme Court.
Names of the victims have been redacted, and in many of the cases no criminal charges were filed, according to the LA Times.

The online files will allow for a search by city, state, troop number or name of suspected abuser.
All files have been uploaded individually.
The files contain reports of suspected sexual abuse by scout leaders from 1965 to 1985 across the country.
The documents contain more than 20,000 pages and identify more than 1,200 leaders and volunteers banned from the Boy Scouts for suspected abuse.
Many states have no statutes of limitations for crimes committed against children when they were younger than 16, so the release of the files could very well lead to a wave of criminal and civil cases, according to the Associated Press.
The Boy Scouts were ordered to hand over the files during a 2010 trial that ended with an $18.5 million damage award for the victim of abuse by a scout leader.
The organization appealed that ruling all the way to the Oregon Supreme Court, where it lost.
According to CNN, for decades, the Boy Scouts kept the files' contents secret, arguing confidentiality was needed to protect victims' privacy and encourage the reporting of suspected abuse.
But in many cases, the organization failed to report abuse to proper law enforcement.
"We're talking about hundreds, if not thousands of unidentified men who should be registered sex offenders who are roaming free in society, free to volunteer with other youth organizations, to work at schools and that sort of thing," lawyer of an abused scout, Tim Hale, told CNN.
The Boy Scouts of America have apologized and said new reports of abuse are no longer hidden by the organization but handed over to police.
"There have been instances where people misused their positions in Scouting to abuse children, and in certain cases, our response to these incidents and our efforts to protect youth were plainly insufficient, inappropriate, or wrong. Where those involved in Scouting failed to protect, or worse, inflicted harm on children, we extend our deepest and sincere apologies to victims and their families," Wayne Perry, BSA President said in a news release.
The Boy Scouts also released a video statement apologizing for the sexual abuse, and detailing recent policy changes.
"These policies include insuring at least two adults are present at all activities, preventing one-on-one contact between an adult and a youth member, requiring every scouting activity be opened to observation by parents, and mandating that suspicions of abuse be reported to the proper local authorities and to scouting leadership," Bob Mazucca, Former BSA Chief Scout Executive said.
The documents will not show the names of victims or of witnesses, but will include the names of some of the suspected abusers.
